RESOLUTION NO. 030993

 

Amending the Washington Wheatley/Wendell Phillips/Downtown East Plan by amending the Proposed Land Use Plan and Map for an approximately 1.93 acre tract of land generally bounded by E. 20th Street on the south, the Kansas City Terminal Railway on the north, Olive Street on the east, and Brooklyn Avenue on the west, by changing the proposed land use recommendations for open space uses to residential uses. (413-S-8)

 

WHEREAS, on March 14, 1996, the City Council by Resolution No. 960082 adopted the Washington Wheatley/Wendell Phillips/Downtown East Plan being the Plan for development and redevelopment of that area generally located north of 27th Street, east of Troost Avenue, west of I-70, and south of Truman Road; and

 

WHEREAS, on July 23, 1998, the City Council approved an amendment to the Washington Wheatley/Wendell Phillips/Downtown East Plan through the adoption of Resolution No. 980754, amended the Plan on January 4, 2001, through the adoption of Resolution No. 001634, amended the Plan on January 25, 2001, through the adoption of Resolution No. 010066, and further amended the Plan on May 23, 2002, through the adoption of Resolution No. 020439; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Washington Wheatley/Wendell Phillips/Downtown East Plan as it affects the area generally bounded by E. 20th Street on the south, the Kansas City Terminal Railway on the north, Olive Street on the east and Brooklyn Avenue on the west, by changing the recommended land uses for the area from open space uses to residential uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on April 21, 2003; and

 

WHEREAS, the City Plan Commission considered such amendments to the Proposed Land Use Plan and Map on May 6, 2003; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on May 6, 2003, recommend approval of the proposed amendments to the Washington Wheatley/Wendell Phillips/Downtown East Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Washington Wheatley/Wendell Phillips/Downtown East Plan is hereby amended as to the Proposed Land Use Plan and Map for the area generally bounded by E. 20th Street on the south, the Kansas City Terminal Railway on the north, Olive Street on the east, and Brooklyn Avenue on the west, by changing the recommended land uses for the area from open space uses to residential uses. A copy of the amendment to the Washington Wheatley/Wendell Phillips/Downtown East Plan is attached hereto as Exhibit A and incorporated herein by reference.

 


Section B. That the amendment to the Washington Wheatley/Wendell Phillips/Downtown East Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
