COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090398

 

Authorizing the Director of Public Works to enter into an agreement with the Kansas City Area Transportation Authority for the provision of regular transit services, and Share-A-Fare transportation for the elderly and disabled residents of Kansas City, Missouri; Appropriating funds from the KCATA Sales Tax Fund Balance and the Public Mass Transportation Fund Balance; authorizing an expenditure in an amount not to exceed $45,498,201.00; and authorizing a reduction in payments in April of 2010 should sales tax collections not meet budgeted estimates.

 

WHEREAS, the City is supportive of efforts to provide maximum support to the Kansas City Area Transportation Authority; and

 

WHEREAS, the City and KCATA are attempting to resolve prior year payments in the amount of $1,517,000 to insure that the City's and the KCATA are accounts are in alignment; and

 

WHEREAS, to resolve this accounting issue and to provide the maximum available funds for transit services in the City for FY 2009-10. The City will allocate nearly all of the available reserves in the KCATA Sales Tax funds (No. 2290) and Public Mass Transportation Fund (No. 2080) to the KCATA to accomplish these objectives; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is hereby authorized to enter into an agreement with the Kansas City Area Transportation Authority to provide funding for regular transit services, the Share-A-Fare program, which provides transportation for elderly persons and persons with disabilities, and specialized reverse commute transportation services for residents of Kansas City, Missouri, for a period of one year beginning May 1, 2009 through April 30, 2010, per the attached agreement.

 

Section 2. That the sum of $743,145.00 is appropriated from the Unappropriated Fund Balance of the KCATA Sales Tax Fund to the following account

 

10-2290-692000-F KCATA Operations $743,145.00

 

Section 3. That the sum of $2,556,649.00 is appropriated from the Unappropriated Fund Balance of the Public Mass Transportation Fund to the following account:

 

10-2080-692000-F KCATA Operations $2,556,649.00

 


Section 4. That the Director of Public Works is hereby authorized to expend an amount not to exceed $45,498,201.00 from funds previously appropriated to the following accounts in the 2009-2010 Budget and not to exceed the amount of the funds so budgeted:

 

10-2080-692000-F KCATA Operations $24,108,552.00

10-2290-692000-F KCATA Operations 21,389,649.00

TOTAL $45,498,201.00

 

Section 5. That the Director of Public Works is authorized to reduce the April 2010 payment to the KCATA by an amount equal to any shortfall in sales tax collections to insure that the City's transit funds remain in balance.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
