RESOLUTION NO. 030839

 

Approving an amendment to the Westside Area Plan by modifying the Land Use Plan and Map for an area of approximately .26 acres generally located in the northwest corner of the intersection of W. 16th Street and Jarboe Street to recommend neighborhood retail business uses instead of one- and two-family residential uses. (121-S-3)

 

WHEREAS, by Committee Substitute for Resolution No. 971137 adopted September 4, 1997, the City adopted the Westside Area Plan as a guide for development and redevelopment of that area generally bounded by 12th Street on the north, 31st Street on the south, Broadway on the east and the Bluffs and Southwest Boulevard on the west; and

 

WHEREAS, said Westside Area Plan was amended on October 24, 2002, through the adoption of Resolution No. 021193; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Westside Area Plan as it affects that area of approximately .26 acres generally located in the northwest corner of the intersection of 16th Street and Jarboe Street by modifying the Proposed Land Use Plan and Map for such area from one- and two-family residential uses to neighborhood retail business uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on June 30, 2003; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on June 15, 2003; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on June 15, 2003, recommend approval of the proposed amendment to the Westside Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the first amendment to the Westside Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area of approximately .26 acres generally located on the northwest corner of the intersection of 16th Street and Jarboe Street by modifying the Proposed Land Use Plan and Map for such area from one- and two-family residential uses to neighborhood retail business uses. A copy of the amended Land Use Plan and Map for the Westside Area Plan is attached hereto as Exhibit A and made a part hereof.

 

Section B. That the amendment to the Westside Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
