Approving
an amendment to a previously approved preliminary plan in Districts GP-1 (General
Industry) and GP-2 (General Transient Retail Business) on approximately a 4.72
acre tract of land generally located in the northeast corner of the
intersection of N.W. 104th Street and N. Ambassador Drive. (10015-GP-7)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved preliminary plan in Districts
GP-1 (General Industry) and GP-2 (General Transient Retail Business) on
approximately a 4.72 acre tract of land generally located in the northeast
corner of the intersection of N.W. 104th Street and N. Ambassador Drive, and
more specifically described as follows:
Lots 4 and 5, Block 2; Lots 1, 2, 3, 4, 5, 6 and
7, Block 3, and Lot 3, Block 5, all in Ambassador Park, a subdivision in Kansas
City, Platte County, Missouri, according to the recorded plat thereof.
is
hereby approved, subject to the following conditions:
1. That
the developer submit a storm drainage study to the City Engineers Office for
approval at the time of platting and that the developer make any improvements
as required by the City Engineers Office.
2. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
3. That
the developer obtain the grading consents, and all grading, temporary
construction and drainage easements from the abutting property owners prior to
submitting any public improvements.
4. That
the developer subordinate all private interest in the area of any right of way
dedication as required by the Department of Public Works.
5. That
the developer construct and/or reconstruct sidewalks and curbs along
development street frontages as required by the Department of Public Works at
the time of building permit issuance.
6. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
7. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources if the disturbed area for the entire development exceeds five
acres.
8. That the developer extend
sanitary and/or storm sewers and determine adequacy as required by the
Department of Public Works.
9. That the developer relocate
sanitary and/or storm sewers so as to remove building encroachments within the
sewer easement limits as required by the Department of Public Works.
10. That the developer install hard
surface roads and provide for fire protection as required by the Fire
Department prior to construction beyond foundations.
11. That the developer submit a
final plan to the City Plan Commission for approval, including detailed
information on landscaping, grading, signage (including elevations), building
elevations for each structure per staff approval, and lighting, including a
photometric study.
A copy of said amendment is
on file in the office of the City Clerk under Document No. 030681, which is
attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
