RESOLUTION NO. 010286
Declaring
the intent of the Council to not approve any amendments to the Central
Industrial District Industrial Development Plan of the Planned Industrial
Expansion Authority of Kansas City, Missouri, which would provide for the
approval of residential projects in the Central Industrial District Plan area
and declaring the intent of the Council to not approve tax incentives through
LCRA, TIF or Chapter 353 for residential projects in the West Bottoms area.
WHEREAS,
the Central Industrial District Industrial Development Plan was approved by the
Planned Industrial Expansion Authority of Kansas City, Missouri, (PIEA) and was
passed by the City Council through the passage of Ordinance No. 48892 on April
7, 1978; and
WHEREAS,
the approved Central Industrial District Industrial Development Plan provides
that "[p]roposed land uses within the project area shall be limited to
private industrial development within the meaning of Section 100.310(9), RSMo
(1969), as amended"; and
WHEREAS,
in order for developers to use development incentives, including tax abatement
and the power of eminent domain, provided by the Planned Industrial Expansion
Authority through Chapter 100, RSMo, for residential development projects, the
currently approved Central Industrial District Industrial Development Plan
would be required to be amended through the passage of an ordinance by the
Council; and
WHEREAS,
there are a number of owners of commercial and industrial businesses who are
greatly concerned about allowing residential developments in the West Bottoms
area and are particularly concerned that their properties will be condemned for
residential developments and concerned with tax incentives being given to
residential developers by the Council; and
WHEREAS,
the Council does not believe it is appropriate to provide tax incentives or
other development incentives through PIEA, the Tax Increment Financing
Commission, the Land Clearance for Redevelopment Authority or through Chapter
353 plans approved by the City Council for residential development projects in
the West Bottoms area;
WHEREAS,
the Council believes that if residential housing is permitted to occur in the
West Bottoms area it should be market rate; primarily, if not exclusively,
involve the conversion of warehouse buildings to loft apartments; be completed
without any City development incentives, including the use of the power of
eminent domain and any tax abatement or incentives, controlled by the City
Council; and be consistent and in conformance with the City's Central
Industrial District Area Plan; NOW, THEREFORE,
BE
IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
That
the Council hereby declares its intent to not approve any amendments to the
Central Industrial District Industrial Development Plan of the Planned
Industrial Expansion Authority of Kansas City, Missouri, which would provide
for the approval of residential projects in the Central Industrial District
Plan area and its intent to not approve tax incentives through LCRA, TIF or
Chapter 353 for residential projects in the West Bottoms area.
