ORDINANCE NO. 060684
Authorizing the Director Public
Works to enter into a cooperative agreement with the Downtown Council of Kansas
City for the installation, operation, and maintenance of bollards and
appurtenant structures within Case Park.
WHEREAS, the Downtown
Council has approached the City with a proposal to close Case Park during the overnight hours to vehicular traffic by installing a system of bollards and
signage; and
WHEREAS, these
items are installed within the public right-of-way, it is necessary that the City
and the Downtown Council enter into a Cooperative Agreement for the
installation, operation, and maintenance of the bollards and appurtenant
structures within Case Park; and
WHEREAS, the Downtown
Council is an association of businesses and property owners organized for the
purpose of creating a vibrant and economically healthy downtown; and
WHEREAS, the
Downtown Council has identified certain issues which need to be addressed
regarding the overnight use of Case Park, located at the intersection of
Jefferson Street and 8th Street; and
WHEREAS, the
Downtown Council, Public Works Department, and the Parks & Recreation
Department agree that the construction of bollards for the purpose of closing
the park to vehicular traffic during the overnight hours would be in the best
interest of the City; and
WHEREAS, the
cooperative agreement addresses the installation, operation, and maintenance of
the bollards and appurtenant structures within Case Park; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the
Director of Public Works is hereby authorized to execute a Cooperative
Agreement, to be in a form substantially as that attached hereto as Exhibit A,
and incorporated herein by reference.
Section 2. That the
City Clerk is hereby directed to file copies of this ordinance, together with
the Cooperative Agreements, I the Office of the Recorder of Deeds of Jackson
County, Missouri together with all other relevant documents.
