ORDINANCE NO. 060241

Estimating and appropriating special assessment collections in association with the 108th & Cookingham Public Improvement Project within Fund 6820, the Neighborhood Improvement District (NID Fund) in the amount of $199,175.00; and designating requisitioning authority.

WHEREAS, the Missouri Development Finance Board (MDFB) issued its Infrastructure Facilities Revenue Bonds, Series 2005 for the 108th & Cookingham Public Improvement Project; and

WHEREAS, Kansas City, Missouri (City) entered into a Financing Agreement (Agreement) dated March 1, 2005 with MDFB, Sunflower Development, L.L.C. and First Bank of Missouri (Trustee); and

WHEREAS, the Agreement requires the City to assess special assessments (Special Assessments) against the properties within the NID District Project created by Ordinance No. 010535 passed on April 19, 2001; and

WHEREAS, the Agreement requires the City to bill and transfer Special Assessments receipts, subject to annual appropriation, to the Trustee; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the revenue in the following account of Fund No. 6820, the Neighborhood Improvement District Fund, is hereby estimated in the following amount:

06-6820-120000-484000 Collection from Assessments $199,175.00

Section 2. That the sum of $199,175.00 is hereby appropriated from the Unappropriated Fund Balance of Fund No. 6820, the Neighborhood Improvement District Fund, to the following account:

06-6820-129639-B 108^th & Cookingham Spec Assessment $199,175.00

Section 3. That the Director of Finance is hereby designated as requisitioning authority for Account No. 06-6820-129639.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
