COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 001705

 

Approving an amendment to a previously approved Community Unit Project on an approximately 28.48 acre tract of land generally located at the southwest corner of N.W. 56th Street and N. Northwood Road. (12441-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project on an approximately 28.48 acre tract of land generally located at the southwest corner of N.W. 56th Street and N. Northwood Road, and more specifically described as follows:

 

A tract of land in the Northwest Quarter of Section 32, Township 51, Range 33, Kansas City, Platte County, Missouri, being bounded and described as follows: Commencing at the northeast corner of said Northwest Quarter; thence North 89E14'02" West along the north line of said Northwest Quarter, 29.41 feet; thence South 0E45'58" West, 30.00 feet to the true point of beginning of the tract to be herein described; thence South 0E22'30" East, 724.05 feet; thence South 89E36'00" West, 203.71 feet; thence South 0E22'30" East, 208.75 feet to a point on the south line of the North One-Half of said Northwest Quarter; thence South 89E36'00" West, along said south line, 1021.62 feet; thence North 0E22'30" West, 180.00 feet; thence South 89E37'30" West, 160.00 feet; thence North 0E22'30" West, 781.13 feet to a point on the south right of way line of N.W. 56th Street, as now established; thence South 89E14'02" East, along said south line, 1385.60 feet to the true point of beginning. Containing 28.48 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

3. That the developer dedicate additional right of way for N.W. 56th Street as required by the Department of Public Works so as to provide a total of 80 feet of right of way as measured from the centerline of N.W. 56th Street.

 

4. That the developer improve the south half of N.W. 56th Street to secondary arterial street standards as required by the Department of Public Works, including construction of curbs, gutters, and sidewalks and installation of streetlights.

 

5. That the developer dedicate additional right of way for N. Northwood Road as required by the Department of Public Works so as to provide a total of 40 feet of right of way as measured from the centerline of N. Northwood Road.

 


6. That the developer improve the west half of N. Northwood Road to secondary arterial street standards as required by the Department of Public Works, including construction of curbs, gutters, and sidewalks and installation of streetlights.

 

7. That the developer construct future N. Camden Avenue to collector street standards with a total right of way of 60 feet as required by the Department of Public Works, including construction of curbs, gutters, and sidewalks and installation of streetlights.

8. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

9. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

10. That the developer secure a grading permit from the Department of Codes Administration prior to beginning any construction activities.

 

11. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

12. That the developer submit a street name signage plan for the entire development to the Street Naming Committee for approval prior to submittal of the first final plat.

 

13. That the developer extend sanitary sewers as required by the Department of Public Works.

 

14. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

15. That the developer extend water mains and provide easements as required by the Water Services Department.

 

16. That the developer submit off-site temporary cul-de-sac easements by separate document as required by the Department of Public Works.

 

17. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

18. That the developer submit a final plan for all proposed community facilities (walking trails, etc.) to the City Plan Commission for approval, including plans for landscaping, screening, signage (including elevations), and grading.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 001705, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
