COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 000919

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0295, rezoning an area of approximately 70.24 acres generally located on the east side of U.S. Highway 169, between N.W. 96th Street on the south and approximately 120 feet south of N.W. 100th Terrace on the north, from District RA (Agricultural) to District R-4 (Low Apartments). BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0295, rezoning an area of approximately 70.24 acres generally located on the east side of U.S. Highway 169, between N.W. 96th Street on the south and approximately 120 feet south of N.W. 100th Terrace on the north, from District RA (Agricultural) to District R-4 (Low Apartments), said section to read as follows:

 

Section 80-11A0295. That an area legally described as:

 

A tract of land situated in the SW 1/4 Section 35, Township 52, Range 33, Kansas City, Clay County, Missouri, described as follows: Beginning at a point on the north line of said SW 1/4, said point being South 89E35'18" East, along said line, 152.72 feet from the northwest corner of said SW 1/4, said point being also the southwest corner of Romey Hills - 4th Plat, a subdivision in said Kansas City; thence South 89E35'18" East, along said north line, 1874.66 feet to the northwest corner of North Oak Christian Church, a subdivision in said Kansas City; thence South 0E24'42" West, along the west line of said North Oak Christian Church, 360.00 feet; thence South 89E35'18" East, along the southerly line of said North Oak Christian Church, 187.90 feet; thence southeasterly, continuing along said southerly line, along a curve to the right having a radius of 220.00 feet and tangent to the last described course, an arc distance of 185.99 feet; thence southeasterly, continuing along said southerly line, along a curve to the left having a radius of 280.00 feet and tangent to the last described curve, an arc distance of 124.65 feet; thence South 66E39'25" East, continuing along said southerly line, 79.89 feet (Plat = 79.79 feet); thence southeasterly, continuing along said southerly line, along a curve to the right having a radius of 32.06 feet and tangent to the last described course, an arc distance of 37.48 feet to the west right of way line of N. Oak Trafficway; thence South 00E20'00" West, along said right of way line, 50.00 feet west of and parallel with the east line of said SW 1/4, 218.33 feet; thence North 88E54'22" West, 688.31 feet; thence South 08E14'09" West, 443.76 feet; thence North 22E17'23" West, 352.48 feet; thence South 13E03'02" West, 414.37 feet; thence South 43E29'46" West, 113.53 feet to the northerly right of way line of N.E. 96th Street; thence North 44E06'14" West, along said right of way, 27.46 feet; thence northwesterly, continuing along said right of line, 115.00 feet from and parallel with the centerline thereof, on a curve to the left having a radius of 1260.92 feet and an initial tangent bearing of North 46E30'14" West, an arc distance of 930.32 feet; thence South 89E54'20" West, continuing along said right of way line, 215.74 feet to the easterly right of way line of U.S. Highway


No. 169; thence North 01E06'12" West, along said right of way line, 410.00 feet from and parallel with the centerline thereof, 385.08 feet; thence North 26E33'44" West, continuing along said right of way line, 581.58 feet; thence North 01E06'12" West, continuing along said right of way line, 160.00 feet from and parallel with the centerline thereof, 770.33 feet to the point of beginning. Containing 3,059,331 square feet or 70.2326 acres.

 

is hereby rezoned from District RA (Agricultural) to District R-4 (Low Apartments), all as shown outlined on a map marked Section 80-11A0295, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
