ORDINANCE NO. 940580

 

Approving an amendment to a previously approved development plan in District GPO (Office) on a 69.19 acre tract of land generally located south of 129th Street and east of Raytown Road. (9638-GP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GPO (Office) on a 69.19 acre tract of land generally located south of 129th Street and east of Raytown Road, and more specifically described as follows:

 

All that part of the Southwest Quarter of Section 16, the Southeast Quarter of Section 17, the Northeast Quarter of Section 20 and the Northwest Quarter of Section 21, all in Township 47, Range 32, in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the southwest corner of the Southeast Quarter of the Southeast Quarter of said Section 17; thence north along west line of said 1/4 1/4 Section, 1333.71 feet to the northwest corner thereof; thence east along the north line of said 1/4 1/4 Section, 1327.26 feet to the northeast corner thereof, being also the northwest corner of the Southwest Quarter of the Southwest Quarter of said Section 16; thence east along the north line of said 1/4 1/4 Section, 180 feet to its intersection with the corporate limit line between Kansas City and Lee's Summit, Missouri, as now established; thence south along said corporate limit line, being 180 feet east of and parallel with the west line of said Section 16, a distance of 1334.20 feet to a point on the north line of said Section 21; thence continuing south along said corporate limit line, 180 feet east of and parallel with the west line of said Section 21, 682.59 feet; thence northwesterly along a curve to the left, having a radius of 750 feet, a central angle of 1618'32" and an initial tangent which deflects 12224'02" right from the last described course, a distance of 213.48 feet to a point which is 14 feet west of the east line of said Section 20, measured parallel with the north line of said Section 20; thence south, parallel with said east line of Section 20, a distance of 724.18 feet to a point on the south line of the Northeast Quarter of the Northeast Quarter of said Section 20; thence west along said south line, 580.70 feet; thence north, parallel with the west line of said 1/4 1/4 Section, 429.00 feet; thence west parallel with the south line of said 1/4 1/4 Section, 734.06 feet (742.50 feet, deeded) to a point on the west line of said 1/4 1/4 Section; thence north along said west line, 180.05 feet; thence east, parallel with the south line of said 1/4 1/4 Section, 659.69 feet; thence east and northeasterly along a curve to the left, from the last described course as a tangent, having a radius of 400 feet, and a central angle of 6052'04", a distance of 424.94 feet; thence northeasterly, tangent to the last described curve, a distance of 12.74 feet; thence northwesterly along a curve to the right from the last described course as a normal, having a radius of 600 feet, and a central angle of 4859'25", a distance of 513.02 feet; thence northwesterly, tangent to the last described curve, a distance of 39.35 feet; thence southwesterly along a curve to the right, from the last described course as a normal, having a radius of 1145.92 feet, and a central angle of 1200'00", a distance of 240 feet, thence west, tangent to the last described curve, 477.58 feet to a point on the west line of said 1/4 1/4 Section; thence north 77.28 feet to the northwest corner thereof and the point of beginning. Containing 69.19 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer extend water mains as required by the Water Department.

 

3. That the developer provide for fire protection as required by the Fire Department.

 

4. That the developer submit a storm drainage study to the City Engineer's Office for approval, including provision

for any needed improvements.

 

5. That the developer extend off-site sanitary sewers to serve each building with a separate sewer service

connection.

 

6. That the developer dedicate additional right of way on the east side of Raytown Road, if required by the City,

for a total of 50 feet of right of way from centerline.

 

7. That the developer improve the east half of Raytown Road to primary arterial street standards, including curbs,

gutters, sidewalks and streetlights.

 

8. That the developer submit a landscaping plan for each phase of the development prior to the issuance of a

building permit.

 

9. That the developer grant a noise and aviation easement to the City.

 

10. That the developer provide a statement on all plans and plats that the proposed development is located within the

area of the Richards-Gebaur Air Force Base Height

Restrictions and provide that no structure be built which

exceeds these restrictions.

 

11. That the developer secure a floodplain certificate prior to any work within the 100 year floodplain.

 

12. That the developer improve one-half of Raytown Road and 129th Street to the extent necessary to meet collector

street standards for sidewalks.

 

13. That the developer dedicate 30 feet of right of way for 129th Street to the City as measured from the centerline

of 129th Street.

 

14. That the developer submit plans for the review and approval of the Public Works Department for any island

cuts in Sherer Parkway and for the need for left turn and

right turn lanes.

 

15. That the developer provide a full disclosure statement.

 

16. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for

approval prior to beginning any construction.

 

17. That the developer obtain a land disturbance permit from the Missouri Department of Natural Resources.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 940580, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had. _____________________________________________

 

I hereby certify that as required by Chapter 39, Code of General Ordinances, the foregoing ordinance was duly advertised and public hearings were held.
