ORDINANCE NO. 970331

 

Approving an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on an approximately 0.8 acre tract of land generally located at the northwest corner of 87th Street and Hillcrest Road. (7712-P-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on an approximately 0.8 acre tract of land generally located at the northwest corner of 87th Street and Hillcrest Road, and more specifically described as follows:

 

The following described property situated in the Northeast Quarter of Section 23, Township 48, Range 33: Starting at the intersection of the centerline of said 87th Street and the centerline of said Hillcrest Road; thence northerly along the centerline of said Hillcrest Road 40 feet; thence westerly along the north right of way line of said 87th Street produced, 30 feet to a point at the intersection of the north right of way line of said Hillcrest Road from the point of beginning; thence northerly along the said west right of way line of said Hillcrest Road 200 feet; thence westerly at right angles to the last described course 200 feet; thence southerly at right angles to the last described course 200 feet to a point in the north right of way line of said 87th Street; thence easterly along the said north right of way line of 87th Street, 200 feet, more or less, to the point of beginning, all in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any necessary improvements as required by the

City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer provide fire protection as required by the Fire Department.

 

6. That the developer contribute $12,350.00 to the I-435/I-470 Corridor Study Improvement Fund based on a rate of $325.00 per motel room as required by the

Department of Public Works.

 

7. That the developer dedicate additional right of way for 87th Street as required by the Department of Public Works so as to provide a total of 65 feet of right of way as

measured from the centerline of 87th Street.

 

8. That the developer contribute $26,800.00 for the improvement of 87th Street to primary arterial street standards at a rate of $134.00 per front foot as required by the

Department of Public Works.

 

9. That the developer improve the west side of Hillcrest Road to collector street standards as required by the Department of Public Works, including construction of

sidewalks and curbs and installation of streetlights.

 

10. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping and signage.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 970331, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
