Approving the preliminary plat of KC Condo Garages on approximately
a 1.04 acre tract of land generally located on the east side of Oak Street, approximately 1,000 feet south of 135th Street and west of the Missouri Pacific
Railroad track. (SD 1340)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of KC Condo Garages on approximately a 1.04 acre tract of
land generally located on the east side of Oak Street, approximately 1,000 feet
south of 135th Street and west of the Missouri Pacific Railroad track, and more
specifically described as follows:
All that part of the
Northwest Quarter of the Southeast Quarter of Section 20, Township 47, Range
33, in Kansas City, Jackson County, Missouri, being more particularly described
as follows: Beginning at the Southwest corner of the Northwest Quarter of the
Southeast Quarter of said Section 20 (found 1 aluminum monument); thence
North 032937 East along the West line of said Quarter Quarter Section and
the East right-of-way line of Oak Street a distance of 287.37 feet; thence
South 855115 East a distance of 221.75 feet to the Westerly right-of-way line
of the Missouri Pacific Railroad (found 1 pipe); thence South 272750 West
along said right-of-way line a distance of 312.94 feet to the South line of the
Northwest Quarter of the Southeast Quarter of said Section 20 (found iron
bar with cap number 2157); thence North 855009 West along the South line of
said Quarter Quarter Section a distance of 94.61 feet to the point of
beginning.
is hereby approved, subject to
the following conditions:
1. That the developer
cause the area to be platted and processed in accordance with Chapter 66, Code
of Ordinances of the City of Kansas City, Missouri, commonly known as the
Subdivision Regulations.
2.
That the developer submit covenants, conditions and restrictions to
Development Services for review by the Law Department for approval for the
maintenance of common elements and private open space tracts.
3. That
the developer enter into a ten year secured deferral agreement for the
improvement of the east half of Oak Street to local street standard including
curb, gutter, sidewalks and streetlights as required by Development Services,
if the City requests this improvement.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
