COMMITTEE SUBSTITUTE FOR
ORDINANCE NO. 990121
Designating an expansion of the Kansas
City/Claycomo Satellite Enterprise Zone and directing the City Manager to apply
for State designation of the expanded satellite zone.
WHEREAS, Missouri Enterprise Zone
law was revised in 1989 by the addition of Section 135.207, RSMo, which allows
for designation of one satellite enterprise zone in any Missouri community
classified as a village whose borders lie adjacent to a city whose population
exceeds four hundred thousand and which has an existing state designated
enterprise zone; and
WHEREAS, the village must contain
within its corporate limits a factory, mining operation, mill, plant or
warehouse which has at least three thousand employees and has an investment in
plant, machinery and equipment of at least two hundred million dollars; and
WHEREAS, the local governing
authorities of both the village and the adjacent city with the existing
enterprise zone must approve the satellite enterprise zone; and
WHEREAS, after approval of the
satellite zone proposal by the local governing authorities, the Director of the
Missouri Department of Economic Development can designate the area as a
satellite enterprise zone; and
WHEREAS, the City of Kansas City,
Missouri, and the Village of Claycomo both conferred satellite enterprise zone
status on a site in the Village of Claycomo in 1990 and the Missouri Department
of Economic Development formally designated this area as a satellite enterprise
zone on January 22, 1991; and
WHEREAS, after joint designation in
1994 by the City of Kansas City, Missouri, and the Village of Claycomo, the
Missouri Department of Economic Development formally designated an expansion of
the satellite enterprise zone on March 10, 1995; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section 1. That the area generally
described below located within the Village of Claycomo, Clay County, Missouri,
and including area owned by the Ford Motor Company be designated by the City of
Kansas City, Missouri, as the Kansas City/Claycomo Satellite Enterprise Zone:
Beginning at the point
where the Ford Motor Company property line which runs generally along side and
parallel to the U.S. Highway 69 departs from the highway and turns southeast
running along Big Shoal Creek; continuing southeast along the Ford property
line past the point where it departs to the southwest from Big Shoal Creek
until the property line again adjoins the creek at the point where the creek intersects
with the Claycomo/Liberty city limits; then south along the Claycomo/Liberty
city limits line to the point where the city limits line turns east; then east
along the Claycomo/Liberty city limits line, which also constitutes the
northern boundary of 1990 Census Tract 208.02, Block 513A, to its intersection
with Hughes Road; then south and southwest along Hughes Road, which constitutes
the
eastern boundary of 1990
Census Tract 208.02, Block 513A, to the point where Hughes Road intersects with
Big Shoal Creek; thence northwest along Big Shoal Creek, which also constitutes
the Kansas City/Claycomo city limits, to the point on the creek where the
Kansas City/Claycomo city limits line turns west; then west along the city
limits line to the point on the west side of the Norfolk & Western Railroad
tracks where the Ford Motor Company property line intersects the city limits
line; then generally north along the Ford property line to its point of
intersection with the security fence forming the southern boundary of the paint
building; then west along the security fence to a point on a line lying
parallel to and 100 feet west of the west face of the expanded paint building;
then north along this line for approximately 500 feet; then west for
approximately 1,300 feet; then north for approximately 1,200 feet to Ravena
Road (also known as Claycomo Road); then east along Ravena Road for
approximately 1,000 feet to the point where the eastern boundary of the Kansas
City Power & Light Company (KCP&L) yard turns north; then north,
northwest and west around the perimeter of the KCP&L property and
continuing along the northern boundary of the truck convoy lot to a point
approximately 175 feet past the boundary between the KCP&L yard and the
truck convoy lot; thence proceeding due north to a point just north of the
railroad spur line which is to the south and parallel to the convoy storage
yard, then northwest to the Ford property line which runs parallel to Highway
69; then northeast along the property line to the point of beginning.
Section 2.
That the City Manager is hereby authorized and directed to apply to the
Director of the Department of Economic Development of the State of Missouri for
designation of the above mentioned area as the Kansas City/Claycomo Satellite
Enterprise Zone pursuant to Sections 135.207 and 135.210, RSMo, and to comply
with all prerequisites to designation.
Section 3.
That a qualified business located within the Kansas City/Claycomo Satellite
Enterprise Zone shall be subject to the same eligibility criteria and may be
eligible to receive the same benefits as a qualified business in the existing
Kansas City, Missouri Enterprise Zone as specified in Sections 135.200 to
135.256, RSMo.
Section 4.
That the City Council further declares its intent to give reasonable
consideration for any future amendment to extend the boundaries of the Kansas
City/Claycomo Satellite Enterprise Zone at such time as a development plan is
proposed for the expansion area.
