ORDINANCE NO. 931401

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2496, rezoning an area of approximately 0.31 acres generally located on the south side of N.W. 64th Terrace and west of N. Cosby Avenue from Districts R-2a (Two-Family Dwellings) and CP-1 (Neighborhood Planned Business Center) to District CP-1 (Neighborhood Planned Business Center), and approving a preliminary plan for the same. (6576-CP-15)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2496, rezoning an area of approximately 0.31 acres generally located on the south side of N.W. 64th Terrace and west of N. Cosby Avenue from Districts R-2a (Two-Family Dwellings) and CP-1 (Neighborhood Planned Business Center) to District CP-1 (Neighborhood Planned Business Center), said section to read as follows:

 

Section 65.010A2496. That an area legally described as:

 

All that part of Lot 17, "WEXFORD PLACE FIFTH PLAT", a subdivision of land in the City of Kansas City, Platte County, Missouri, described as follows: Beginning at the southeast corner of said Lot 17, said point being on the north right of way line of Missouri State Highway Route No. 45 (N.W. 64th Street), as now established; thence North 8954'54" West, along said north right of way line and the south line of said Lot 17, a distance of 69.00 feet; thence North 005'06" East, a distance of 177.81 feet, to a point on the south right of way line of N.W. 64th Terrace, as now established, said point also being on the north line of said Lot 17, said point being a point on a curve; thence easterly along said south right of way line and said north line of Lot 17, along a curve to the left, having an initial tangent bearing of North 8736'07" East, a radius of 625.00 feet, a central angle of 621'35", a distance of 69.37 feet, to the northeast corner of said Lot 17; thence South 005'06" West, along the east line of said Lot 17, a distance of 184.65 feet, to the point of beginning, containing 12,460 square feet or 0.2860 of an acre, more or less.

 

is hereby rezoned from Districts R-2a (Two-Family Dwellings) and CP-1 (Neighborhood Planned Business Center) to District CP-1 (Neighborhood Planned Business Center), all as shown outlined on a map marked Section 65.010A2496, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer receive the approval for a lot split.

 

2. That the developer secure a permit for the construction of sidewalks along the entire frontage of the existing

day care center as well as the proposed parking lot prior

to the approval of the lot split.

 

3. That the developer submit a final plan for approval, including provisions for landscaping.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 931401, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
