ORDINANCE NO. 001596

 

Approving and designating Redevelopment Project No. 37 of the Briarcliff West Tax Increment Financing Plan, as amended, as a Redevelopment Project and adopting tax increment financing therein.

 

WHEREAS, the City Council of Kansas City, Missouri, by Ordinance No. 54556, passed on November 24, 1982, and thereafter repealed and amended in certain respects by Committee Substitute for Ordinance No. 911076, as amended, passed on August 29, 1991, created the Tax Increment Financing Commission of Kansas City, Missouri (the Commission); and

 

WHEREAS, on May 3, 1990, the City Council passed Ordinance No. 65497, which accepted the recommendations of the Commission as to the Briarcliff West Tax Increment Financing Plan (Redevelopment Plan) and designated the Redevelopment Area therein to be a blighted area; and

 

WHEREAS, on November 21, 1991, the City Council passed Committee Substitute for Ordinance No. 911387, which accepted the recommendations of the Commission as to the First Amended Briarcliff West Tax Increment Financing Plan and designated the expanded Redevelopment Area therein as a blighted area; and

 

WHEREAS, on November 17, 1994, the City Council passed Ordinance No. 941342, which accepted the recommendations of the Commission as to the Second Amendment to Briarcliff West Tax Increment Financing Plan and designated the expanded Redevelopment Area as a blighted area; and

 

WHEREAS, on July 31, 1997, the City Council passed Ordinance No. 970713, which approved the Third Amendment to the Briarcliff West Tax Increment Financing Plan (Third Amendment) and designated the expanded Redevelopment Area as a blighted area; and

 

WHEREAS, on _____________________, the City Council passed Ordinance No. 001595, which approved the Fourth Amendment to the Briarcliff West Tax Increment Financing Plan (Fourth Amendment) and designated the expanded Redevelopment Area as a blighted area; and

 

WHEREAS, the Redevelopment Plan, as amended, and Ordinance No. 65497, Committee Substitute for Ordinance No. 911387, Ordinance No. 941342, Ordinance No. 970713, and Ordinance No. 001595 contemplate the implementation of the Redevelopment Plan, as amended, through 37 total Redevelopment Projects (including 1 additional Redevelopment Project authorized by the Fourth Amendment in Ordinance No. 001595) and the adoption of tax increment financing in the area selected for such Redevelopment Project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. All terms used in this ordinance not otherwise defined herein, shall be construed as defined in Sections 99.800 to 99.865 of the Revised Statutes of Missouri, as amended.

 


Section 2. The area selected for Briarcliff West Redevelopment Project No. 37, legally described as follows:

 

TRACT 1 (tax parcel no. 13-804-02-13):

A tract of land in the Southwest Quarter (SW ) of Section 34, Township 51, Range 33, Kansas City, Clay County, Missouri, described as follows: Beginning at a point 240.08 feet West and 1159.8 feet North of the Southeast corner of the Southwest Quarter (SW ) of Section 34; thence West to a point 399.88 feet West of the East line of said Southwest Quarter (SW ) of Section 34, 535.3 feet to the Northerly Right-of-Way line of U.S. Highway No. 69; thence Easterly along said Northerly Right-of-Way line of U.S. Highway No. 69 to a point, said point being 240.08 feet West of the East line of said Southwest Quarter (SW ) of Section 34; thence North to the point of beginning; except that part in U.S. Highway No. 71 (I-29) and excepting any parts taken for streets or roadway.

 

TRACT 2 (tax parcel no. 13-804-02-11):

All that part of the Southwest of Section 34, Township 51, Range 33, in Kansas City, Clay County, Missouri, described: Beginning at a point 876.10 feet North of the South line and 399.88 feet West of the East line of said Southwest ; thence South and parallel to the East line of said Southwest a distance of 110.00 feet; thence West and parallel to the South line of said Southwest a distance of 138.72 feet; thence North and parallel to the East line of said Southwest a distance of 110.00 feet; thence East and parallel to the South line of said Southwest a distance of 138.72 feet to the point of beginning.

 

and (tax parcel no. 13-804-02-10):

 

All that part of the Southwest of Section 34, Township 51, Range 33, in Kansas City, Clay County, Missouri, described as follows: Beginning at a point 766.10 feet North of the South line and 399.88 feet West of the East line of said Southwest ; thence South and parallel to the East line of said Southwest a distance of 141.30 feet to a point in the North Right-of-Way line of U.S. Highway No. 69, thence West along the North line of said Highway 139.99 feet to a point in a line which is 538.60 feet West of the East line of said Southwest a distance of 135 feet; thence East and parallel to the South line of said Southwest , a distance of 138.72 feet to the point of beginning.

All that part of the Southwest of Section 34, Township 51, Range 33, in Kansas City, Clay County, Missouri, described: Beginning at a point 1,159.8 feet North of the South line and 399.88 feet West of the East line of said Southwest ; thence South and parallel to the East line of said Southwest a distance of 270 feet; thence West and parallel to the South line of said Southwest a distance of 138.72 feet; thence North and parallel to the East line of said Southwest a distance of 270 feet; thence East and parallel to the South line of said Southwest a distance of 138.72 feet to the point of beginning.

 

TRACT 4 (tax parcel no. 13-804-02-14):

A tract of land in the Southwest of Section 34, Township 51, Range 33, Clay County, Missouri described as follows: Beginning at a point in the East line of the Southwest of said Section 34, 1159.8 feet North of the Southeast corner thereof; thence West 399.88 feet; thence South and parallel to said East line of the Southwest of Section 34, 535.3 feet to the Northerly line of Highway No. 69, thence Easterly along said Northerly line on Highway No. 69, 148.19 feet to a point; thence Southwesterly 10 feet; thence Southeasterly along the Northerly line of Highway No. 69, 273.4 feet to said East line of the Southwest of said Section 34; thence North 667.3 feet to the point of beginning; except tract conveyed to Marvin F. Morgan and Helen E. Morgan by deed recorded in Book 411 at Page 492, subject to conveyances of record to the State of Missouri for road purposes including deed recorded in Book 583 at Page 212, and except that part of said tract conveyed to State of Missouri (State Highway Commission) by Deed described as Tract 18, in 1972.

 

TRACT 5 (tax parcel no. 13-804-2-09):

The West 25 feet (measured along the North line) of the following described tract of land. A tract of land in the Southwest Quarter of Section 34, Township 51, Range 33, Kansas City, Clay County, Missouri, described as follows: Beginning at a point 399.88 feet West of the East line and 1159.80 feet North of the South line of said Southwest Quarter; thence South 535.30 feet to the North line of Highway No. 69; thence Westerly 140.0 feet along said North line of the Highway; thence South 10 feet; thence Westerly along said North line of the Highway 23.92 feet; thence North and parallel with the first described line 539.70 feet; thence East 163.72 feet to the point of beginning. Also, the East 60 feet of the following described tract of land, a tract of land in the Southwest Quarter of Section 34, Township 51, Range 33, in Kansas City, Clay County, Missouri, described as follows: Beginning at a point 563.60 feet West of the East line and 1159.80 feet North of the South line of said Southwest Quarter; thence South 539.70 feet to the Northerly line of Highway 69; thence Westerly along the Northerly line of said Highway 69, a distance of 362.69 feet; thence North 620.35 feet; thence East 353.07 feet to the point of beginning.

is approved and designated as Briarcliff West Redevelopment Project No. 37 (hereinafter Project No. 37).

 

Section 3. Tax increment allocation financing is hereby adopted for taxable real property in the above described area selected for Project No. 37. After the total equalized assessment valuation of the taxable real property in Project No. 37 exceeds the certified total initial equalized assessed valuation of the taxable real property in Project No. 37 the ad valorem taxes and payment in lieu of taxes, if any, arising from the levies upon the taxable real property in such project by taxing districts and tax rates determined in the manner provided in subsection 2 of Section 99.855 each year after the effective date of the ordinance until redevelopment costs have been paid shall be divided as follows:

 

1. That portion of taxes levied upon each taxable lot, block, tract, or parcel of real property which is attributable to the initial equalized assessed value of each such taxable lot, block, tract or parcel or real property in the area selected for Project No. 37 shall be allocated to and, when collected, shall be paid by the Clay County Collector and the City Treasurer to the respective affected taxing districts in the manner required by law in the absence of the adoption of tax increment allocation financing;

 

2. Payments in lieu of taxes attributable to the increase in the current equalized assessed valuation of each taxable lot, block, tract, or parcel of real property in the area selected for Project No. 37 over and above the initial equalized assessed value of each such unit of property shall be allocated to and, when collected, shall be paid to the City Treasurer who shall deposit such payment in lieu of taxes into a special fund called the Special Allocation Fund of the City for the purpose of paying Redevelopment Project Costs and obligations incurred in the payment thereof. Any payments in lieu of taxes which are not paid within 60 days of the due date will be deemed delinquent and assessed a penalty of 1% per month.

 

Section 4. In addition to the payments in lieu of taxes described in subsection 2 of Section 3 above, 50% of the total additional revenue from taxes which are imposed by the City or taxing districts, and which are generated by economic activities within the area selected for Project No. 37 over the amount of such taxes generated by economic activities within such area in the calendar year prior to the passage of this ordinance, while tax increment financing remains in effect, but excluding taxes imposed on sales of charges for sleeping rooms paid by transient guests of hotels and motels, licenses, fees or special assessments and personal property taxes, other than payments in lieu of taxes, shall be allocated to, and when paid by the collecting officer to the City Treasurer or other designated financial officer of the City, who shall deposit such funds in a separate segregated account within the Special Allocation Fund.
