ORDINANCE NO. 951394

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2612, rezoning an area of approximately 1.32 acres generally located at the southeast corner of 39th Street and Montgall Avenue from District R-2b (Two-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2612, rezoning an area of approximately 1.32 acres generally located at the southeast corner of 39th Street and Montgall Avenue from District R-2b (Two-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), said section to read as follows:

 

Section 65.010A2612. That an area legally described as:

 

The north 11.00 feet of Lot 6 and all of Lots 7,8, and 9, "Carolyn Addition", a subdivision in Kansas City, Jackson County, Missouri, and all that part of the Northwest 1/4 of the Southwest 1/4 of Section 22, Township 49, Range 33, described as follows: Beginning at the southeast corner of 39th Street and Montgall Avenue in Kansas City, Missouri; thence east along the south line of said 39th Street, 133.70 feet, more or less, to a point midway between the east line of Montgall Avenue and the west line of Chestnut Avenue in said City; thence south and parallel with the east line of said Montgall Avenue to the north line of "Carolyn Addition", thence west along the north line of Carolyn Addition, aforesaid, to the east line of said Montgall Avenue; thence north along the east line of said Montgall Avenue to the point of beginning. Containing 57,402 square feet or 1.318 acres, more or less.

 

is hereby rezoned from District R-2b (Two-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), all as shown outlined on a map marked Section 65.010A2612, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved. A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 951394, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
