ORDINANCE NO. 061134

 

Rezoning an area of approximately 1.97 acres generally located at the southwest corner of N.E. 88th Street and N. Oak Trafficway from District R-4-O to District PD/R-4-O. (11894-PD-3).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0703, rezoning an area of approximately 1.97 acres generally located at the southwest corner of N.E. 88th Street and N. Oak Trafficway from District R-4-O (Low Apartments, Administrative Office) to District PD/R-4-O (Planned District/Low Apartments, Administrative Office), said section to read as follows:

 

Section 80-11A0703. That an area legally described as:

 

All that part of Lots 1, 2 and 3, GASHLAND HEIGHTS RESURVEY, a subdivision of land in Kansas City, Clay County, Missouri being described as follows:

 

Commencing at the Northwest corner of the East half of said Lot 1; thence along the West line of the East half of said Lot 1, South 00 degrees 40 minutes 34 seconds West, a distance of 5.00 feet to a point 5 feet southerly of the North line of said Lot 1, also being the Southerly Right-of-Way line of Northeast 88th Street, and being the Point of Beginning of the Tract of land herein to be described; thence along a line lying 5 feet southerly and parallel to the North line of said Lot 1, also being said Southerly Right-of-Way line, North 89 degrees 54 minutes 01 seconds East, a distance of 144.66 feet; thence continuing along said Southerly Right-of-Way, Southeasterly along a curve to the right, being tangent to the last described course, having a radius of 25.00 feet, an arc distance of 39.63 feet to a point on the Westerly Right-of-Way line of North Oak Trafficway, also being a point 20 feet Westerly of the East line of said Lot 1; thence along said Westerly Right-of-Way line, also being 20 Westerly of and parallel to the East line of Lots 1 and 2, South 00 degrees 40 minutes 34 seconds West, a distance of 369.68 feet to a point on the South line of said Lot 2, also being a point on the North line of said Lot 3; thence continuing along said Westerly Right-of-Way line, also being the South line of said Lot 2, and being the North line of said Lot 3, North 89 degrees 54 minutes 01 seconds East, a distance of 20.00 feet to the Southeast corner of said Lot 2, also being the Northeast corner of said Lot 3; thence continuing along said Westerly Right-of-Way line, also being the East line of said Lot 3, South 00 degrees 40 minutes 34 seconds West, a distance of 100.01 feet to the Southeast corner of said Lot 3; thence along the South line of said Lot 3, South 89 degrees 54 minutes 01 seconds West, a distance of 190.00 feet to the Southwest corner of the East half of said Lot 3; thence along the West line of the East half of said Lots 3, 2 and 1, North 00 degrees 40 minutes 34 seconds East, a distance of 495.05 feet to the Point of Beginning. Said tract contains 1.97 Acres, more or less.

 

is hereby rezoned from District R-4-O (Low Apartments, Administrative Office) to District PD/R-4-O (Planned District/Low Apartments, Administrative Office), all as shown outlined on a map marked Section 80-11A0703, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a macro/micro storm drainage study to Development Services for approval for the entire development when the first plat is submitted, and that the developer construct any improvements as required by Development Services.

 

3.                  That the developer dedicate additional right of way for primary arterial with a bike lane as required by Development Services so as to provide a minimum of 56 feet of right of way as measured from the centerline of N. Oak Trafficway.

 

4.                  That the developer construct an east bound right turn lane onto N. Oak Trafficway from N.E. 88th Street as required by Development Services

 

5.                  That the developer provide a cross access easement for all lots within the development as required by Development Services, and show said easement on the final plat.

 

6.                  That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer shall be responsible for all costs associated with subordination activities.

 

7.                  That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curb, and gutter are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

8.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

9.                  That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities.

 

10.              That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

11.              That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

12.              That access restrictions be provided to restrict access to N. Oak Trafficway from only the shared driveway for all lots and that the restriction be placed on the Final Plat.

 

13.              That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any storm water detention area tracts.

 

14.              That the developer submit a final plan to the City Plan Commission for approval including plans for landscaping including street trees, grading, wall signage, screening, berming, fencing, and lighting (provide a photometric study, showing zero footcandles at the property line) and building elevation drawings.

 

15.              That the developer grant an Aviation Noise Easement, for each phase of the development, to the City and file same with each final plat as required by the Aviation Department.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
