ORDINANCE NO. 900866, AS AMENDED
Approving the plat of University Park, First Plat, an
addition in Kansas City, Jackson County, Missouri; accepting and releasing
various easements; establishing grades on public ways; authorizing the Director
of Public Works and Director of City Development, respectively, to execute
certain agreements, and authorizing the City Clerk to file this ordinance and
attached agreement.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the plat of University Park, First
Plat, a subdivision in Kansas City, Jackson County, Missouri, a true and
correct copy of which is attached hereto and incorporated herein by reference
is hereby approved.
Section 2. That the plat granting and reserving
unto Kansas City an easement and license or right to locate, construct, operate
and maintain facilities including, but not limited to, water, gas, sewerage,
telephone, cable TV, surface drainage, underground conduits, pad mounted transformers,
service pedestals, any and all of them upon, over, under and along the strips
of land outlined and designated on the plat by the words utility easement or
U/E be and the same are hereby accepted and where other easements are outlined
and designated on the plat for a particular purpose, be and the same are hereby
accepted for the purpose as therein set out.
Section 3. That the grades of the streets and other
public ways set out on the plat, herein accepted, are hereby established at the
top of curb, locating and defining the grade points which shall be connected by
true planes or vertical curves between such adjacent grade points, the
elevations of which are therein given, in feet above the City directrix.
Section 4. That all right, title and interest in a
sewer easement accepted by Kansas City, under Ordinance No. 18456, passed
October 30, 1901, and an utility easement reserved in Vacation Ordinance No.
48848 recorded on Document No. K361366, Book 834, Page 2001 be and the same is
hereby released to the respective owner, their successors or assigns, over that
part of aforesaid easement described as follows:
Ordinance No. 18456 (Sewer Easement) The rear 3
feet of Lots 7 thru 26, Block 4, FAIRLAND, a subdivision in Kansas City,
Jackson County, Missouri, as dedicated by said subdivision, together with
the north 3.0 feet of the west 15.00 feet of Lot 14, Block 1, said
FAIRLAND.
Ordinance No. 48848 (Utility Easement) A
portion of the intersection of 48th Street and Rockhill Road lying
easterly of the east line of Rockhill Road and being more particularly
described as follows: Beginning at a point on the west line of Block 25,
"Amended Plat of Rockhill" 68.95 feet south of the northwest
corner thereof; thence south along the southerly prolongation of the
west line of said Block 25, 82.95 feet to an intersection with the
westerly prolongation of the south line of said Block 25; thence east
along the prolongation of the south line of said Block 25, 82.95 feet to a
point 56.33 feet west of the southeast corner of said Block 25,
thence westerly, northwesterly and northerly along the southwesterly line
of said Block 25, being a curve to the right and having a radius of 80.0
feet, 128.59 feet to the point of beginning.
Section 5. That the Director of Public Works is
hereby authorized to execute a cooperative agreement for contribution to the
Plaza Environs, a copy of which is attached hereto as Exhibit "A" and
incorporated herein by reference.
Section 6. That the Director of City Development is
hereby authorized to execute a cooperative agreement for design of University
Park, a copy of which in substantial form is attached hereto and incorporated
herein by reference.
Section 7. That the City Clerk is hereby directed
to file copies of this ordinance, together with the cooperative agreement for
contribution to the Plaza Environs, attached hereto, in the Office of the
Secretary of the State of Missouri and in the Office of the Recorder of Deeds
of Jackson County, Missouri together with all other relevant documents.
Section 8. That the Council finds that the City
Plan Commission has duly endorsed its approval of this ordinance hereon.
