ORDINANCE NO. 090064
Amending Committee Substitute for
Ordinance No. 030925 by repealing Section 3 and enacting a new section
regarding the appointment of Commissioners of the Downtown Economic Stimulus
Authority.
WHEREAS, the 92nd
General Assembly of the State of Missouri passed House Bill No. 289 (the
Bill), which among other things enacted the Missouri Downtown and Rural
Economic Stimulus Act, Sections 99.915 to 99.1060, RSMo (the Act); and
WHEREAS, the
City created a Downtown Economic Stimulus Authority (Authority) within the
meaning of the Act and authorize such Authority to exercise the powers,
functions, and duties of an authority under Sections 99.915 to 99.980 by
passage of Committee Substitute for Ordinance No. 030925 (Authorizing
Ordinance); and
WHEREAS, the
Authorizing Ordinance provides that the Authority will consist of 12
Commissioners, plus the Mayor, who will serve as co-chair of the Authority as
provided by the Act; and
WHEREAS, the
Authorizing Ordinance provides that the members of the Tax Increment Financing
Commission of Kansas City, Missouri (the Tax Increment Financing Commission)
shall serve as Commissioners of the Authority; and
WHEREAS, although the
Act provides that the Mayor shall appoint the Commissioners, the Authorizing
Ordinance requires the consent of the Council; and
WHEREAS, the Section
209(a)(3) of the Charter provides that the Mayor shall appoint all members of
boards and commissions except when provided otherwise in this Charter or by
statute, and except for members of a Public Improvement Advisory Committee and
Neighborhood Tourist Development Fund; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Section 3 of Committee Substitute for Ordinance No. 030925 is hereby repealed
and a new section is enacted in its place, to read as follows:
Section 3. The Downtown Economic Stimulus Authority will
consist of representatives as required by the Act, including a community
development corporation representative, a representative of the school district,
an African-American business owner plus other at-large members. All members
will be appointed by the Mayor.
