COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 970815

 

Approving an amendment to the Martin City Area Plan, being that part of Kansas City bounded by Blue Ridge Boulevard on the north, Jackson County-Cass County line on the south, U.S. 71 Highway on the east, and State Line Road on the west, modifying the Land Use Plan for the area generally located at the southwest corner of 137th Street and Holmes Road from "Public Institutional" and "Open Space" to "Business Services and Light Industrial".

 

WHEREAS, by Resolution No. 62809, as amended, adopted September 8, 1988, the City Council adopted the Martin City Area Plan for that part of Kansas City generally located between Blue Ridge Boulevard and the Jackson County-Cass County line and between U.S. 71 Highway and State Line Road; and

 

WHEREAS, the Martin City Area Plan was amended on November 17, 1994, through the adoption of Resolution No. 941538; and

 

WHEREAS, the City Development Department has considered the propriety of amending the Land Use Plan for the southwest corner of 137th Street and Holmes Road due to changed circumstances and conditions; and

 

WHEREAS, the current Land Use Plan for the southwest corner of 137th Street and Holmes Road provides for "public institutional" and "open space" and it is appropriate to modify that designation to "business services and light industrial"; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on March 31, 1997, for the purpose of considering an amendment to the Martin City Area Plan; and

 

WHEREAS, on May 6, 1997, the City Plan Commission held a hearing on said amendment and all persons interested in such amendment were given an opportunity to testify; and

 

WHEREAS, the City Plan Commission did on May 6, 1997, recommend approval of an amendment to the Land Use Plan for the Martin City area to provide for a modification of the land use plan for the southwest corner of 137th Street and Holmes Road from "public institutional" and "open space" to "business services and light industrial"; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the second amendment to the Martin City Area Plan is hereby approved for the purpose of modifying the Land Use Plan for the southwest corner of 137th Street and Holmes Road from "public institutional" and "open space" to "business services and light industrial" in accordance with the amended Land Use Plan which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that all public notices and hearings required by law have been given and had.
