COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090034

 

Repealing Resolution No. 911385, requiring a review by the City Auditor of the budget proposed by the City Manager; Amending Section 2-722, Code of Ordinances, Governance Assessment Checklist by requiring the City Auditor to conduct a survey of boards and commissions at least once every four years rather than annually; and repealing Committee Substitute for Ordinance No. 080477 authorizing a cooperative agreement with Jackson County to audit the Jackson County and Kansas City election boards.

 

WHEREAS, the Finance and Audit Committee asked the City Auditor to provide recommendations for improving office operations; and

WHEREAS, the City Auditor recommended the Finance and Audit Committee eliminate the requirement of one recurring audit, modify the frequency of another recurring audit, and eliminate an individual audit; and

WHEREAS, on December 11, 1991, the City Council adopted Resolution No. 911385, directing the City Auditor to review and comment upon the budget as presented by the City Manager in March of each year and that the City Auditors comments be submitted to the Mayor and City Council prior to the passage of the budget by the City Council; and

WHEREAS, directing the City Auditor to comment on the City Managers proposed budget limits the scope and timing of information the City Auditor could provide to assist the City Council during its budget deliberations; and

WHEREAS, on August 27, 2001, the City Council passed Ordinance No. 011307, enacting a new Section 2-722, Code of Ordinances, entitled Governance assessment checklist; and

WHEREAS, Section 2-722 requires the City Auditor to annually distribute a governance assessment checklist to all appropriate governing or policy boards of the City, including component unit boards and commissions; and requires the City Auditor to annually distribute the results of the governance assessment checklist no later than November 1 each year; and

WHEREAS, limited audit resources would be better served by less frequent completion and reporting of the governance assessment checklist; and

WHEREAS, on May 15, 2008, the City Council passed Committee Substitute for Ordinance No. 080477, authorizing the City Auditor to execute an intergovernmental agreement with Jackson County, Missouri, to conduct an audit of the Jackson County Board of Election Commissioners and the Kansas City Board of Election Commissioners; and

WHEREAS, Jackson County, Missouri, postponed initiating the audit until after the November 4, 2008 presidential election; and

WHEREAS, the Council agreed to the audit in hopes of identifying operational improvements that could be implemented in time to positively affect the November 4, 2008 presidential election; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Resolution No. 911385 is repealed.

Section 2. That Section 2-722, Code of Ordinances, Governance assessment checklist, is amended to read as follows:

Sec. 2-722.  Governance assessment checklist.

 

(a)   Purpose.  Use of a governance assessment checklist by all boards and commissions of the city will further the responsiveness and efficiency of government. 

 

(b)   Distribution of governance assessment checklists.   

 

(1)    Checklist.  The city auditor will distribute a governance assessment checklist, substantially like that presented in the special report entitled "Good Governance Practices for Boards and Commissions" presented to the city council on August 15, 2001, to all appropriate governing or policy boards of the city, including component unit boards and commissions, at least once every four years. 

 

(2)    Special report.  The city auditor will provide a copy of the special report entitled "Good Governance Practices for Boards and Commissions" presented to the city council on August 15, 2001, upon request, which may include availability on the internet or in electric format. 

 

(3)    Availability of the city auditor.  The city auditor will be available to provide additional necessary information upon request of a board or commission. 

 

(c)   Completion and submission of checklists.  All boards and commissions receiving a governance assessment checklist will submit to the City Auditor by April 30 of the year in which the checklist is distributed a completed checklist. Boards and commissions are free to add information to the checklist. 

 

(d)   Report to the council.  The city auditor will report to the mayor and city council the results of the governance assessment checklists no later than November 1 of each year in which the checklists are distributed. 

 

(e)   Exceptions.  In recognition of the transitory nature or single focus of advisory and ad hoc boards and commissions, those boards and commissions will not be required to complete a governance assessment checklist. 

 

(f)   Voluntary participation.  The city auditor will invite other boards and commissions providing public services to the city but not constituted as governing or policy boards of the city, or as component unit boards and commissions. The city auditor will include in the report to the council the boards invited to participate, those choosing to participate, and those not participating. 

Section 3. That Committee Substitute for Ordinance No. 080477 is repealed.
