ORDINANCE NO. 000411

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0279, rezoning an area of approximately 7 acres generally located south of 77th Street between Holmes Road and Campbell Street from District R-5-p (High Apartments - Limited District) to District R-5 (High Apartments).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0279, rezoning an area of approximately 7 acres generally located south of 77th Street between Holmes Road and Campbell Street from District R-5-p (High Apartments - Limited District) to District R-5 (High Apartments), said section to read as follows:

 

Section 80-11A0279. That an area legally described as:

 

TRACT 4: All that part of Lots G and J, Garden Place, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point which is 10 feet east of the west line and 12 feet north of the south line of the North Half (N 1/2) of said Lot G; thence east, parallel with the south line of the North Half (N 1/2) of said Lot G, 130 feet; thence north, parallel with the west line of said Lot G, 100 feet; thence east, parallel with the south line of the North Half (N 1/2) of said Lot G, 189 feet, more or less, to a point 300 feet west of the east line of said Lot G; thence north parallel with the east line of said Lot G, 50 feet, more or less to a point 155 feet south of the north line of said Lot G; thence east, parallel with said north line, 275 feet, to a point on the west line of Campbell Street, as now established, 25 feet west of the east line of said Lot G; thence south parallel with the east line of said Lots G and J and along the west line of said Campbell Street, 491.46 feet to a point 12.5 feet south of the north line of said Lot J; thence west, parallel with the north line of said Lot J, 594.01 feet, to a point on the east line of Holmes Street, as now established, 10 feet east of the west line of said Lot J; thence north along said east line of Holmes Street, 12.5 feet to a point on the north line of said Lot J; thence continuing north along a line 10 feet east of and parallel with the west line of said Lot G, 329.17 feet to the point of beginning. Except the east 10 feet of the west 40 feet of the south 329.17 feet of said Lot G, conveyed to Kansas City, Missouri, according to the recorded plat thereof.

 

TRACT 5: The west 10 feet of the South Half (S 1/2) and the west 10 feet of the south 12 feet of the North Half (N 1/2) of Lot G, Garden Place, a subdivision in Kansas City, Missouri.

 

is hereby rezoned from District R-5-p (High Apartments - Limited District) to District R-5 (High Apartments), all as shown outlined on a map marked Section 80-11A0279, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
