ORDINANCE NO. 900738

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2354, rezoning an area of approximately 7.14 acres located at the southeast corner of U.S. 40 and Logan Road from Districts R-4-p (Low Apartments - Limited District) and C-2-p (Local Retail Business - Limited District) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2354, rezoning an area of approximately 7.14 acres located at the southeast corner of U.S. 40 and Logan Road from Districts R-4-p (low apartments - limited district) and C-2-p (local retail business - limited district) to District C-2-p (local retail business - limited district), said section to read as follows:

 

Section 65.010A2354. That an area legally described as:

 

All that part of the Southwest Quarter of Section 25, Township 49, Range 32, Kansas City, Jackson County, Missouri, being more particularly described as follows:

 

Beginning at the Northwest corner of said Southwest Quarter; thence South 206'33" West along the West line of said Southwest Quarter, a distance of 577.19 feet; thence South 8709'12" East, 225 feet; thence North 206'33" East, 29 feet; thence South 8709'12" East, 423.18 feet; thence North 205'19" East, 296.71 feet to a jog; thence North 8708'48" West along said jog; 9.97 feet; thence North 205'19" East, 251.48 feet to a point on the North line of the Southwest Quarter of said Section 25; thence North 8709'12" West along said North line, 638.01 feet to the point of beginning. Less and except that part now in road and highway.

 

 

is hereby rezoned from Districts R-4-p (low apartment - limited district) and C-2-p (local retail business - limited district) to District C-2-p (local retail business - limited district), all as shown outlined on a map marked Section 65.010A2354, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer dedicate 55 feet of right of way from the centerline of U.S. 40 to the State of Missouri.

 

2. That the developer dedicate 30 feet of right of way from the centerline of Logan Road to a point 250 feet south of

U.S. 40 and then taper to a 25 foot right of way from the

centerline.

 

3. That the developer improve one-half of Logan Road to the extent necessary to meet standards for collector streets

for a distance of 250 feet south of U.S. 40 and then

taper to a residential street width.

 

4. That the developer improve U.S. 40 by constructing a 6 foot pavement with a 10 foot shoulder and sidewalk

according to Missouri Highway and Transportation

Department standards.

 

5. That the developer secure all necessary permits from the State of Missouri Highway and Transportation Department

for all work within the State right of way.

 

6. That the developer submit a storm drainage study to the City Engineer including provision for any needed

improvements.

 

7. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

8. That the developer extend water mains in accordance with current City standards and regulations.

 

 

A copy of said preliminary plan is on file in the Office of the City Clerk under Document No. 900738, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
