Rezoning an area of approximately 5.244 acres generally located at 7100 E. 50th Street from Districts B3-2 and R-1.5 to District B4-5. (14430-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-_____, rezoning an area of approximately 5.244 acres generally located at 7100 E. 50th Street from Districts B3-2 (Community Business dash 2) and R-1.5 (Residential 1.5) to District B4-5 (Heavy Business/Commercial, dash 5), said section to read as follows:

 

Section 88-__________. That an area legally described as:

 

TRACT 1: TRACT A, AS SHOWN ON THE CERTIFICATE OF SURVEY FOR A LOT SPLIT OF LOT 6, EASTWOOD VIEW SECOND PLAT, A SUBDIVISION OF LAND IN THE CITY OF KANSAS CITY, JACKSON COUNTY, MISSOURI. (ACCORDING TO THE PLAT FILED AUGUST 20, 1974, IN BOOK 34 AT PAGE 14), SAID CERTIFICATE OF SURVEY HAVING BEEN FILED DECEMBER 19, 1997, AS DOCUMENT NUMBER 97K61028, AND SAID TRACT A OF SAID CERTIFICATE OF SURVEY BEING DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

 

THAT PART OF LOT 6, EASTWOOD VIEW SECOND PLAT, A SUBDIVISION OF LAND IN THE CITY OF KANSAS CITY, JACKSON COUNTY, MISSOURI, DESCRIBED AS FOLLOWS:

 

BEGINNING AT THE SOUTHEAST CORNER OF SAID LOT 6; THENCE NORTH 87º 52' 08" WEST ALONG THE SOUTH LINE OF SAID LOT 6, 315.85 FEET; THENCE NORTH 2º 07' 52" EAST, 135.35 FEET; THENCE NORTH 87º 44' 28" WEST, 180.00 FEET; THENCE NORTH 71º 19' 08" WEST, 65.30 FEET TO A POINT ON THE WEST LINE OF SAID LOT 6; THENCE NORTHEASTERLY, NORTHERLY, AND NORTHWESTERLY ALONG A CURVE TO THE LEFT WITH A RADIUS OF 610.48 FEET, AND AN INITIAL TANGENT BEARING OF NORTH 18º 40' 52" EAST, SAID CURVE BEING THE WEST LINE OF SAID LOT 6, 313.02 FEET; THENCE NORTH 69º 52' 56" EAST 7.11 FEET ALONG THE NORTH LINE OF SAID LOT 6 TO A POINT OF CURVATURE; THENCE CONTINUING NORTHEASTERLY ALONG SAID NORTH LINE, ON A CURVE TO THE RIGHT WITH A RADIUS OF 102.40 FEET AND TANGENT TO THE LAST DESCRIBED COURSE, 56.70 FEET; THENCE CONTINUING ALONG SAID NORTH LINE, SOUTH 78º 23' 34" EAST, 38.37 FEET; THENCE CONTINUING ALONG SAID NORTH LINE, SOUTH 11º 11' 39" WEST, 4.48 FEET; THENCE CONTINUING ALONG SAID NORTH LINE, SOUTH 87º 52' 08" EAST, 491.00 FEET TO THE NORTHEAST CORNER OF SAID LOT 6, SAID POINT BEING ON THE WESTERLY RIGHT-OF-WAY LINE OF INTERSTATE HIGHWAY 435; THENCE SOUTH 7º 18' 38" WEST ALONG THE EAST LINE OF SAID LOT 6, SAID LINE ALSO BEING SAID WESTERLY RIGHT-OF-WAY LINE, 464.16 FEET TO THE POINT OF BEGINNING.

 

TRACT 2: APPURTENANT 50 FOOT ACCESS EASEMENTS AS SHOWN ON THE RECORDED PLAT OF EASTWOOD VIEW SECOND PLAT, RECORDED AUGUST 20, 1974, AS DOCUMENT NO. K-238204, IN PLAT BOOK K-34 AT PAGE 14

 

is hereby rezoned from Districts B3-2 (Community Business dash 2) and R-1.5 (Residential 1.5) to District B4-5 (Heavy Business/Commercial, dash 5) all as shown outlined on a map marked Section 88-________, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 88-20 thereof.

 

Section 2. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
