ORDINANCE NO. 160733

Estimating revenue and appropriating funds in the Strategic Neighborhoods Fund for use in projects within the Hospital Hill II Urban Renewal Plan.

WHEREAS, Committee Substitute for Ordinance No. 991416, passed November 9, 1999, authorized the Director of City Planning and Development to execute a Cooperative Agreement with the Tax Increment Financing Commission of Kansas City, Missouri not to exceed $300,000.00 to relocate a gas line on property generally located south of Linwood Boulevard between Gillham Road and Main Street; and

WHEREAS, Committee Substitute for Ordinance No. 991521, passed on December 9, 1999, authorized the Director of City Planning and Development to execute a Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City, Missouri (“LCRA”) not to exceed $250,000.00 to provide funds for environmental remediation within the then-proposed Longfellow Heights – Phase III residential project area located in the Hospital Hill II Urban Renewal Plan; and

WHEREAS, Ordinance No. 000892, passed July 6, 2000, repealed certain sections of Committee Substitute for Ordinance No. 991416 and authorized the Director of City Planning and Development to execute a Cooperative Agreement with LCRA not to exceed $250,000.00 to provide funds for public improvements and additional site remediation within the Longfellow Heights – Phase III residential project area located in the Hospital Hill II Urban Renewal Plan; and

WHEREAS, two contracts were entered into with LCRA for the environmental remediation and public improvements; and

WHEREAS, the contracts contained provisions allowing LCRA to loan the funds under the Agreements to the selected redeveloper(s) engaged to completed remediation and public improvement activities; and

WHEREAS, the contracts further provided that if the funds loaned to the redeveloper(s) are repaid to LCRA then LCRA “shall pay said funds to the City”; and

WHEREAS, funds under these contracts have been repaid to LCRA and LCRA desires to pay the funds to the City; and

WHEREAS, as the funds were designated for improvements in the Hospital Hill II Urban Renewal Plan, any repaid funds should be designated for use within the Hospital Hill Urban Renewal Plan; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That revenue in the Strategic Neighborhoods Fund is estimated in the following account:

17-2570-570000-458170 Strategic Neighborhoods $92,328.00

Section 2. That funds in the Strategic Neighborhoods Fund are appropriated in the following account for projects as authorized by the Director of the Neighborhoods and Housing Services Department within the Hospital Hill II Urban Renewal Plan area.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
