RESOLUTION NO. 141085

 

Approving an amendment to the Oak Park South Area Plan by amending the Proposed Land Use Plan and Map for an area of approximately .80 acres generally located on the north side of Emmanuel Cleaver II Boulevard, between Forest Avenue and Tracy Avenue, to recommend retail commercial uses instead of low density residential uses. (219-S-17)

 

WHEREAS, the Oak Park South Area Plan was approved by the City Council by Resolution No. 48098, adopted August 18, 1977, as a guide for future development and redevelopment of the area generally located between 39th Street and Leeds Trafficway on the north, Brush Creek Boulevard and Blue Parkway on the south, Troost Avenue on the west, and the Blue River on the east; and

 

WHEREAS, the City Council amended the Oak Park South Area Plan on June 1, 1989, by Resolution No. 63217; and the City Council further amended said plan on March 26, 1992, by Resolution No. 920133; and the City Council further amended said plan on June 30, 1994, by Resolution No. 940643; and the City Council further amended said plan on June 5, 1997, by Resolution No. 970571; and the City Council further amended said plan on May 20, 1999, by Resolution No. 990583; and the City Council further amended said plan on September 27, 2001, by Resolution No. 011205; and the City Council further amended said plan on October 24, 2002, by Resolution No. 021198; and the City Council further amended said plan on January 4, 2004, by Resolution No. 031334; and the City Council further amended said plan on January 13, 2005, by Resolution No. 041369; and the City Council further amended said plan on April 21, 2011, by Resolution No. 110159; and the City Council further amended said plan on October 2, 2014, by Resolution No. 140770; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Oak Park South Area Plan as it affects that area of approximately 80 acres generally located on the north side of Emmanuel Cleaver II Boulevard, between Forest Avenue and Tracy Avenue, to recommend retail commercial uses instead of low density residential uses; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on November 18, 2014; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on November 18, 2014, recommend approval of the proposed amendment to the Oak Park South Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section A. That the tenth amendment to the Oak Park South Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area of approximately 80 acres generally located on the north side of Emmanuel Cleaver II Boulevard, between Forest Avenue and Tracy Avenue, to recommend retail commercial uses instead of low density residential uses. A copy of the thirteenth amendment to the Land Use Plan and Map of the Oak Park South Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That this amendment to the Oak Park South Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been held as required by the law.
