ORDINANCE NO. 011002

 

Approving an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on approximately a 22 acre tract of land generally located on the west side of Southwest Boulevard between 25th and 27th Streets. (11788-URD-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on approximately a 22 acre tract of land generally located on the west side of Southwest Boulevard between 25th and 27th Streets, and more specifically described as follows:

 

All that part of the Southwest Fractional Quarter, and all that part of the Southeast Quarter of Section 7, Township 49 North, Range 33 West, and all that part of the Northwest Fractional Quarter of Section 18, Township 49 North, Range 33 West, in Kansas City, Jackson County, Missouri, including all or part of the following: Lot 3, Gillis Farm, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, Lots 1 through5, inclusive, A. M. Thompsons Subdivision, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, and Lots 35 through 44, inclusive, Block 2, and Lots 4 through 20, inclusive, Block 3, and Lots 21 through 24, inclusive, Block 4, and Lots 36 through 41, inclusive, Block 4, and Lots 1 through 25, inclusive, Block 5, and Lots 31 through 51, inclusive, Block 5, and Lots 6 through 16, inclusive, Block 6, and Lots 27 through 36, inclusive, Block 6, and Lots 6 through 16, inclusive, Block 7, and Lots 22 through 34, inclusive, Block 7, and Lots 8 through 15, inclusive, Block 8, and Lots 31 through 36, inclusive, Block 8, and Lots 5 through 17, inclusive, Block 9, and Lots 4 through 19, inclusive, Block 10, Smith & Keatings South Park Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, and all that part of vacated Southwest Boulevard, which may abut any of said lots in said Smith & Keatings South Park Addition, and Lots 42 through 46, inclusive, Block 4, and Lots 26 through 30, inclusive, Block 5, and Lots 17 through 21, inclusive, Block 6, and Lots 37 through 41, inclusive, Block 6, and Lots 1 through 5, inclusive, Block 7, and Lots 17 through 21, inclusive, Block 7, and lots 16 through 20, inclusive, Block 8, and Lots 37 through 41, inclusive, Block 8, Resurvey of Lots 42 through 46, inclusive, Block 4 and Lots 26 through 30, inclusive, Block 5, and Lots 17 through 21, inclusive, Block 6, and Lots 37 through 41, inclusive, Block 6, and Lots 1 through 5, inclusive, Block 7, and Lots 17 through 21, inclusive, Block 7, and Lots 16 through 20, inclusive, Block 8, and Lots 37 through 41, Block 8, Smith & Keatings South Park Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, together with the vacated streets and alleys vacated by Ordinance No. 29247, a copy of which was recorded in Book B-962 at page 625, as Document No. 538016, said vacated streets including vacated George Street, vacated William Street, vacated James Street, vacated Harold Street, vacated Holly Street, and vacated Elizabeth Street (later called Terrace Street); which lies within the following described tract:

 


All that part of a tract of land in the Southwest Fractional Quarter and Southeast Quarter of Section 7, Township 49 North, Range 33 West, and the Northwest Fractional Quarter of Section 18, Township 49 North, Range 33 West, in the City of Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the southeast corner of the Southwest Quarter of Section 7, Township 49 North, Range 33 West; thence North 87E26'27" West along the south line of the Southwest Quarter of said Section 7, a distance of 440.97 feet; thence North 34E48'30" East, a distance of 29.58 feet to a point on the west right of way line of Southwest Boulevard, as now established, and its intersection with the north right of way line of 27th Street as established by Ordinance No. 31178 and amended by Ordinance No. 33112, the point of beginning; thence continuing North 34E48'30" East along said west right of way line of Southwest Boulevard, a distance of 1570.32 feet; thence North 55E11'30" West, a distance of 139.23 feet; thence South 71E57'54" West, a distance of 585.14 feet; thence South 68E19'48" West, a distance of 75.04 feet; thence South 71E49'14" West, a distance of 238.63 feet; thence South 62E04'39" West, a distance of 148.04 feet to a point of curvature of a curve to the left, said curve being tangent to the last described course, having a radius of 540.00 feet, and a central angle of 50E27'54"; thence southwesterly along the arc of that curve, a distance of 475.62 feet; thence South 11E36'33" West, a distance of 76.48 feet; thence South 32E07'17" East, a distance of 129.65 feet; thence South 28E59'49" East, a distance of 65.07 feet; thence South 24E26'03" East, a distance of 55.64 feet; thence North 65E44'23" East, a distance of 9.05 feet; thence South 45E24'07" East, a distance of 25.25 feet; thence South 36E38'31" East, a distance of 15.65 feet; thence South 11E46'41" East, a distance of 141.41 feet to a point of curvature of a curve to the right, said curve being tangent to the last described course, having a radius of 451.42 feet, and a central angle of 10E52'57"; thence southerly along the arc of that curve a distance of 85.74 feet; thence South 0E54'44" East, a distance of 131.63 feet to the north right of way line of said 27th Street to a point of curvature of a nontangent curve to the left, said curve having an initial tangent bearing South 72E42'31" East, and a radius of 295.00 feet, and a central angle of 7E22'55"; thence along said north right of way line the following 6 (six) courses; (1) thence easterly along the arc of that curve a distance of 38.01 feet; (2) thence South 80E05'26" East, a distance of 80.00 feet to a point of curvature of a curve to the left; said curve being tangent to the last described course, having a radius of 50.00 feet and a central angle of 45E02'33"; (3) thence easterly along the arc of that curve a distance of 39.31 feet; (4) thence North 54E52'01" East, a distance of 42.46 feet to a point of curvature of a curve to the right, said curve being tangent to the last described course, having a radius of 100.00 feet, and a central angle of 37E40'23"; (5) thence easterly along the arc of that curve a distance of 65.75 feet ; (6) thence South 87E26'27" East, 25.00 feet north of and parallel to the south line of the Southwest Quarter of said Section 7, a distance of 43.88 feet to the point of beginning. The above described tract contains 21.62 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer construct curbs, gutters and sidewalks and install streetlights along the southbound lanes of Southwest Boulevard as required by the Department of Public Works.

 

7. That the developer provide for fire protection as required by the Fire Department.

 

8. That the developer install, loop, remove and/or relocate water mains as required by the Water Services Department.

 

9. That the developer provide sanitary sewers as required by the Department of Public Works.

 


10. That the developer submit a site plan to the Director of the Department of City Development for approval prior to the issuance of a building permit. The site plan shall include signage, property uses, setback distances, lighting, landscaping, and architectural characteristics.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 011002, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
