ORDINANCE NO. 120255

Estimating and appropriating revenue in the General Fund for a new probation fee; authorizing a $72,797.61 contract increase with Legal Aid of Western Missouri for representation of indigent defendants; authorizing a $45,000.00 contract increase with Kansas City Metropolitan Crime Commission; and recognizing an emergency.

WHEREAS the Court Administrator is authorized to collect a new service fee for supervision and rehabilitation services to defendants placed on probation, as directed by the Administrative Order of the Presiding Judge, pursuant to Missouri Statues 559.525, 559.604, and 559.607; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That revenue in the following account of the General Fund is estimated in the following amount:

12-1000-270000-465390 Probation Fee $117,797.61

Section 2. That $117,797.61 is appropriated from the Unappropriated Fund Balance of the General Fund to the following accounts:

12-1000-272015-B Municipal Crime Commission $ 45,000.00

12-1000-272005-B Indigent Court Defense 72,797.61

TOTAL $117,797.61

Section 3. That the Administrator of the Municipal Court is hereby authorized to increase Contract No. 010-02 with Legal Aid of Western Missouri to provide legal representation to indigent residents of Kansas City, Missouri, which was approved by Ordinance No. 110280, passed April 21, 2011 from $931,332.00 to $1,004,129.61.

Section 4. That the Administrator of the Municipal Court is hereby authorized to increase Contract No. 11-001 with Kansas City Metropolitan Crime Commission from $45,000.00 to $90,000.00 for management of the metropolitan community service program.

Section 5. That the Court Administrator is hereby authorized to expend the additional sum of $117,797.61 from funds heretofore appropriated to Account Nos. 12-1000-272005-B and 12-1000-272015-B for the aforesaid contract increases.

Section 6. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it appropriates money, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
