ORDINANCE NO. 070306

 

Declaring the area generally located on the east side of Prospect Avenue and both sides of Montgall Avenue between the Kansas city Terminal Railway right of way and 21st Street as blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the 21st & Montgall Urban Renewal Plan. (652-S)

WHEREAS, the area generally located on the east side of Prospect Avenue and both sides of Montgall Avenue between the Kansas city Terminal Railway right of way and 21st Street is (1) blighted by reason of the predominance of defective or inadequate street layout, insanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, retards the provision of housing accommodations or constitutes an economic or social liability or a menace to the public health, safety, morals, or welfare in its present condition or (2) insanitary by reason of a predominance of buildings and improvements which, by reason of dilapidation, deterioration, age or obsolescence, inadequate provision for ventilation, light, air sanitation or open spaces, high density of population and overcrowding of buildings, overcrowding of land, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, is conducive to ill health, transmission of disease, infant mortality, juvenile delinquency and crime or constitutes an economic or social liability and is detrimental to the public health, safety, morals, or welfare; and

 

WHEREAS, on January 16, 2007, the City Plan Commission reviewed this matter and recommended (1) approval of the designation of the area as blighted or insanitary area and (2) approval of the Urban Renewal Plan; NOW, THEREFORE,

 

WHEREAS, on January 24, 2007, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, adopted a resolution recommending that the area be declared blighted or insanitary and recommending approval of an Urban Renewal Plan for the area; and

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds that the proposed urban renewal area identified as the 21st & Montgall Urban Renewal Area generally located on the east side of Prospect Avenue and both sides of Montgall Avenue between the Kansas City Terminal Railway right of way and 21st Street, legally described as:

 

The east 18 feet of the north 14.5 feet of the south 32 feet, and the south 17.5 feet of Lot 1, and all Lots 2 through 22 inclusive and the south 2 feet of Lot 23 except that part in right of way, and the east of the vacated alley lying west of and adjacent said Lots 17 though 22 and the south 2 feet of Lot 23, Parry Place;

 

Lots 1-12 inclusive, Logans 1st Addition except that part in right of way;

 

Lots 1-12 inclusive, P. A. Fredericks 2nd Addition except that part in right of way;

 

Lots 23 through 39 inclusive, F. A. Woods Addition;

 

Lots 1 through 6 inclusive, Montgall Heights;

 

That portion of the SW NW , Section 10, Township 49 North, Range 33 West fronting on the east line of Montgall Avenue between the south line of Montgall Heights and a point 80 feet south of Montgall Heights and ranging 134 feet east;

 

That portion of the SW NW , Section 10, Township 49 North, Range 33 West fronting on the east line of Montgall Avenue between points 80 feet and 150 feet south of the south line of Montgall Heights and ranging 133 feet east;

 

That portion of the SW NW , Section 10, Township 49 North, Range 33 West described as follows: Beginning at the intersection of the north line of 21st Street and the west line of Benton Boulevard, then north 80 feet along the west line of Benton Boulevard, then west 95 feet parallel to 21st Street, then north 20 feet parallel to Benton Boulevard, then west 40 feet parallel to 21st Street, then north 183 feet parallel to Benton Boulevard, then west 120 feet parallel to 21st Street to the east line of Montgall Avenue, then south along said east line to the north line of 21st Street, then east along said north line to the point of beginning,

 

All in Kansas City, Jackson County, Missouri

 

is a blighted or insanitary area need of redevelopment or in need of rehabilitation and is appropriate for an urban renewal project by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, pursuant to Chapter 99, RSMo.

 

Section 2. That the Council finds that the Urban Renewal Plan is feasible and in conformity with the general plan for the development of the community as a whole.

 

Section 3. That the 21st & Montgall Urban Renewal Plan, a copy of which is on file in the office of the City Clerk with this ordinance and is hereby approved.
