ORDINANCE NO. 030144

 

Approving a Community Unit Project on an approximately 90 acre tract of land generally located on the north side of N.E. 104th Street (formerly known as Old Gas House Road), approximately one mile east of N.E. LP Cookingham Drive (Missouri Route 291). (12693-CUP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 90 acre tract of land generally located on the north side of N.E. 104th Street (formerly known as Old Gas House Road), approximately one mile east of N.E. LP Cookingham Drive (Missouri Route 291), and more specifically described as follows:

 

All that part of the Southeast Quarter and all that part of the Southwest Quarter of Section 25, Township 52, Range 32, Kansas City, Clay County, Missouri, being described as follows: Beginning at the northeast corner of the Southwest Quarter of said Section 25; thence South 89E45'06" East, along the north line of said Southeast Quarter, 538.91 feet to a point 950.00 feet east of the northeast corner of the west 90 acres of said Southeast Quarter; thence South 0E31'22" West, parallel with the east line of said west 90 acres, 800.00 feet; thence North 89E45'06" West, parallel with the north line of said Southeast Quarter, 538.91 feet to a point on the east line of the Southwest Quarter of said Section 25; thence South 0E31'22 West, along said east line, 1829.69 feet to the southeast corner of said Southwest Quarter; thence North 89E26'39" West, along the south line of said Southwest Quarter, 1321.82 feet to the southwest corner of the east one-half of said Southwest Quarter; thence North 0E32'09" East, along the west line of said east one-half 2623.42 feet to the northwest corner of said east one-half; thence South 89E42'56" East along the north line of said Southwest Quarter, 1321.23 feet to the point of beginning. Containing 89.58 acres, more or less. Except that part on the south being used for road right-of-way.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 


4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for N.E. 104th Street as required by the Department of Public Works so as to provide a total of 40 feet of right of way as measured from the centerline of N.E. 104th Street.

 

7. That the developer construct a hard surface roadway on N.E. 104th Street from LP Cookingham Drive/Missouri Route 291 to Missouri Route A as required by the Department of Public Works.

 

8. That a waiver to the 3:1 lot depth to width ratio required pursuant to Section 66-124(c)(2) for Lots 5, 34 and 35 as shown on the preliminary community unit project is hereby granted.

 

9. That the developer secure the approval of the Missouri Department of Transportation prior to working within the rights of way for Missouri Route 291 and Missouri Route A.

 

10. That the developer submit a street name signage plan for the entire development to the Street Naming Committee for approval prior to submittal of the first final plat.

 

11. That the developer secure a grading permit from the Department of Codes Administration prior to beginning any construction activities.

 

12. That the developer extend water mains and provide easements as required by the Water Services Department.

 

13. That the developer extend sanitary and storm sewers as required by the Department of Public Works.

 

14. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

15. That the developer submit covenants, conditions and restrictions to the Law Department for approval for maintenance of the common area prior to the approval of the final plat.

 

16. That the developer receive the approval of the Board of Zoning Adjustment for all proposed monument signs (located on private property).

17. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

18. That the developer execute a fair disclosure notice at the time of platting so as to provide notice of the adjacent Roosterville Airport.

 

19. That the developer receive the approval of the City of Liberty for improvements to N.E. 104th Street prior to beginning work on N.E. 104th Street.

 

20. That the developer submit a final plan for all proposed community facilities (walking trails, etc.) to the City Plan Commission for approval, including plans for landscaping screening, signage (including elevations) and grading.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 030144, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
