COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 030097

 

Approving an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on approximately a 0.79 acre tract of land generally located at the northwest corner of 13th Street and Prospect Avenue. (9754-P-9)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on approximately a 0.79 acre tract of land generally located at the northwest corner of 13th Street and Prospect Avenue, and more specifically described as follows:

 

Lot 1, Elainas Place, Block 1, a subdivision of land lying in Kansas City, Jackson County, Missouri,

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval prior to issuance of a building permit and that the developer make any improvements as required by the City Engineers Office.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

3. That the developer repair or replace sidewalks along Prospect Avenue as required by the Department of Public Works.

 

4. That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping (including a new landscaping plan for the existing auto sales lot on the southern half of the property), screening, berming, lighting, and signage. Said landscaping on the existing auto sales lot must be installed prior to the approval of any inspections for the building permits for the new sales lot on the northern portion of the property.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 030097, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
