ORDINANCE NO. 961005
Amending Chapter 65, Revised Ordinances of Kansas City,
Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section
to be known as Section 65.010A2668, rezoning an area of approximately 0.89
acres generally located at the northeast corner of N.E. 82nd Street and N. Oak
Trafficway from Districts R-1a (One Family Dwellings) and C-2 (Local Retail
Business) to District C-2-p (Local Retail Business - Limited District), and
approving a preliminary plan for the same. (11812-P)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 65, Revised Ordinances of
Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby
amended by enacting a new section to be known as Section 65.010A2668, rezoning
an area of approximately 0.89 acres generally located at the northeast corner
of N.E. 82nd Street and N. Oak Trafficway from Districts R-1a (One Family
Dwellings) and C-2 (Local Retail Business) to District C-2-p (Local Retail
Business - Limited District), said section to read as follows:
Section 65.010A2668. That an area legally described
as:
Tract A: All that part of Lots 2 and 3, Clardy
Acres Extension, a subdivision of land in the City of Kansas City, Clay
County, Missouri, described as follows: Beginning at the northwest corner
of said Lot 3; thence South 89 35'37" East, along the north line of
said Lot 3, a distance of 20.00 feet to a point on the easterly right of way
line of N. Oak Street Trafficway, as now established, said point being the
point of beginning; thence continuing South 89 35'37" East, along the
north line of said Lot 3, a distance of 318.50 feet to a point on the
westerly right of way line of the abandoned Q.O. & K.C. Railroad;
thence South 25 19'48" East, along the westerly right of way line of
said abandoned Q.O. & K.C. Railroad, a distance of 124.89 feet; thence
North 89 35'37" West, a distance of 372.65 feet, to a point on the
easterly right of way line of N. Oak Street Trafficway; thence North 00
21'47" East, along the easterly right of way line of N. Oak Street
Trafficway, a distance of 112.50 feet to the point of beginning. Said
tract contains 0.89 acres more or less.
is hereby rezoned from Districts R-1a (One Family
Dwellings) and C-2 (Local Retail Business) to District C-2-p (Local Retail
Business - Limited District), all as shown outlined on a map marked Section
65.010A2668, which is attached hereto and made a part hereof, and which is
hereby adopted as a part of an amendment to the zoning maps constituting a part
of said chapter and as an amendment to Section 65.010 thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer make any improvements as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to the commencement of any construction
activities.
4. That the developer provide on the final plat a
cross-access easement over the drive to the north property line.
5. That the developer construct and maintain all
structures in compliance with the KCI Airport Height Zoning Maps on
file with the City Clerk.
6. That the developer submit a final plan to the
City Plan Commission for approval, including plans for landscaping.
A copy of said preliminary plan is on file in the office
of the City Clerk under Document No. 961005, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
