ORDINANCE NO. 090161

 

Determining compliance of the 909 Walnut 353 Development Plan located on about one acre generally on the east side of Walnut Street, between 9th Street and 10th Street, and authorizing the Director of City Development to issue a Certificate of Full Compliance. (583-S-1)

WHEREAS, the City Council of Kansas City, Missouri, by Ordinance No. 030212 passed on March 27, 2003, approved the development plan submitted by the 909 Walnut Redevelopment Corporation, declared the area included in the plan generally located on the east side of Walnut Street, between 9th Street and 10th Street to be a blighted area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; and authorizing the Director of Finance to enter into a contract (the Redevelopment Contract) with 909 Walnut Redevelopment Corporation; and authorizing certain tax abatement within the Project Area; and

WHEREAS, the Redevelopment Contract was executed and became effective on September 24, 2004; and

WHEREAS, the City Council of Kansas City, Missouri, by Ordinance No. 030212 on March 27, 2003, passed the 909 Walnut Redevelopment Corporation 353 Development Plan for the site located on the east side of Walnut between 9th Street on the north and 10th Street on the south, calling for the rehabilitation of the 909 and 927 Buildings and the new construction of a parking facility; and

WHEREAS, the 909 Walnut Redevelopment Corporation has requested a Certificate of Full Compliance for the entire project; and

WHEREAS, Mr. James Cober, Principal, Corgan Associates, Inc., identified that the $63,573,571 project was completed by December 2006 and consists of the complete rehabilitation of both the 909 and 929 Walnut buildings and the new construction of a 323 space parking garage; and

WHEREAS, on February 17, 2009, the City Plan Commission reviewed the Development Plan and recommended that the construction proposed in the Development Plan and contracts for the 909 Walnut 353 project has been completed and further recommended that the City Council authorize the issuance of a Certificate of Full Compliance to the 909 Walnut Redevelopment Corporation; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section A. That the Council finds and determines that the 909 Walnut Building, 929 Walnut Building and adjacent parking garage, also known as the 909 Walnut "353" Development Plan project, has been completed and the construction in compliance with the approved 353 Development Plan and contract.

Section B. That the Council hereby authorizes the Director of City Development to issue a Certificate of Full Compliance to the 909 Walnut Redevelopment Corporation pursuant to the terms and conditions of the Development Plan and Redevelopment Contract and pursuant to Section 74-17, Code of Ordinances of the City of Kansas City, Missouri, for the 909 Walnut project.
