Approving a preliminary community unit project plan in District R-2b on a 1.67 acre tract of land generally located at 408, 410, 412, 413, 414, 415, 416, 417, 418, 419, 424, 425, 426, 427, 428, 429, 430, and 431 E. 63rd Terrace. (13515-CUP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a preliminary community unit project in District R-2b (Two-Family Dwellings) on a 1.67 acre tract of land generally located at 408, 410, 412, 413, 414, 415, 416, 417, 418, 419, 424, 425, 426, 427, 428, 429, 430, and 431 E. 63rd Terrace, and more specifically described as follows:

 

TRACT 1 (408-418): The west 30 feet of Lot 16 and all of Lots 17, 18 and 19, Block 1, Oak-Meyer Gardens, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at the southwest corner of said Lot 19; thence North 03 degrees 22 minutes 56 seconds West along the west line thereof 125.48 feet to the northwest corner thereof; thence South 86 degrees 49 minutes 38 seconds East along the north line of said lots, 180.00 feet; thence South 03 degrees 22 minutes 56 seconds West 125.48 feet to the north line of 63rd Terrace; thence North 86 degrees 49 minutes 38 seconds West along said north line 180.00 feet to the point of beginning.

 

TRACT 2 (424-430): Part of Lots 12, 13, 14 and 15, Block 1, Oak-Meyer Gardens, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point on the south line of said Lot 15 lying 9 feet west of the southeast corner thereof; thence North 00 degrees 09 minutes 25 seconds East 12.75 feet to a point on the north line of said Lot 15; thence South 86 degrees 49 minutes 38 seconds East along said south line of said lots, 136.07 feet; thence South 01 degrees 16 minutes 36 seconds West 98.60 feet to a point on the northerly line of 63rd Terrace; thence westerly along a curve to the right having an initial tangent bearing of South 76 degrees 20 minutes 36 seconds West and a radius of 630 feet for an arc distance of 135.42 feet to the point of beginning.

 

TRACT 3 (413-419): All of Lots 4 and 5 and the west 20 feet of Lot 6, Block 4, Oak-Meyer Gardens, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at the southwest corner of said Lot 4; thence North 03 degrees 22 minutes 56 seconds East along the west line thereof 121.55 feet to the south line of 63rd Terrace; thence South 66 degrees 49 minutes 38 seconds East along said south line 123.00 feet; thence South 03 degrees 22 minutes 56 seconds West 121.55 feet to the south line of said Lot 6; thence North 86 degrees 49 minutes 38 seconds West along the south line of said lots, 123.00 feet to the point of beginning.

 

TRACT 4 (425-431): Part of Lot 7 and all of Lots 8 and 9, Block 4, Oak-Meyer Gardens, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at the southeast corner of said Lot 9; thence North 86 degrees 49 minutes 38 seconds West along the south line of said lots, 150.00 feet; thence North 02 degrees 12 minutes 03 seconds East 122.95 feet to the southerly line of 63rd Terrace; thence easterly along a curve to the left having an initial tangent bearing of North 89 degrees 27 minutes 10 seconds East and a radius of 680.00 feet for an arc distance of 136.44 feet to the northeast corner of said Lot 9; thence South 03 degrees 46 minutes 54 seconds East along the east line thereof 146.42 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit an indemnification agreement to the Water Services Department for the structure located on the existing sanitary sewer easement and submit a copy of the agreement to City Development staff prior to ordinance request.

 

3. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages in accordance with Chapters 56 and 64, Code of Ordinances, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curb and gutter are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by the Development Services, prior to recording of the plat.

 

4. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common elements and private open space tracts.

 

5. That the developer provide a cross-access easement to allow owners to access garage spaces.

 

6. That the developer secure approval from the Board of Zoning Adjustment for any necessary variances.

 

7. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping and signage (including elevations).

 

A copy of said community unit project plan is on file in the office of the City Clerk under Document No. 970493, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
