ORDINANCE NO. 010229
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0348,
rezoning an area of approximately 13.56 acres generally located west of N.
Ambassador Drive and east of N.W. Plaza Circle from District GP-2 (General
Transient Retail Business) to District GP-3 (Regional Business), and approving
a development plan for the same. (6217-GP-13)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0348, rezoning an area of
approximately 13.56 acres generally located west of N. Ambassador Drive and
east of N.W. Plaza Circle from District GP-2 (General Transient Retail
Business) to District GP-3 (Regional Business), said section to read as
follows:
Section
80-11A0348. That an area legally described as:
Lot 12, Gateway Plaza, a subdivision in the City
of Kansas City, Platte County, Missouri, except that part lying within the
following described tract: Beginning at the northeast corner of Lot 12, said
northeast corner of Lot 12, being the point of intersection of the existing,
platted, southerly right of way line of Gateway Drive; thence South 0E16'22" West, on the platted east
line of Lot 12, Gateway Plaza, 239.81 feet to a point; thence North 89E43'38" West, 482.31 feet to a point
on the west line of Lot 12, Gateway Plaza, said point being on the existing,
platted, easterly right of way line of N.W. Plaza Circle; thence northerly and
easterly on the existing, platted easterly and southerly right of way line of
N.W. Plaza Circle through a curve to the right, having a radius of 275.00 feet,
396.68 feet to a point of tangency; thence continuing on the existing, platted,
southerly right of way line of N.W. Plaza Circle, South 89E43'38" East, 209.57 feet to the
point of beginning. Above described tract contains 590,674 square feet or
13.56 acres, more or less.

hereby rezoned from District GP-2 (General Transient Retail Business) to
District GP-3 (Regional Business), all as shown outlined on a map marked
Section 80-11A0348, which is attached hereto and made a part hereof, and which
is hereby adopted as a part of an amendment to the zoning maps constituting a
part of said chapter and as an amendment to Section 80-11 thereof.
Section
B. That a development plan for the area legally described above is hereby
approved, subject to the following conditions:
1. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer make any necessary
improvements as required by the City Engineers Office.
2. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to the commencement of any
construction activities.
3. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
4. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
5. That
the developer install hard surface roads and provide for fire protection as
required by the Fire Department prior to construction beyond foundations.
6. That
the developer extend sanitary sewers as required by the Department of Public
Works.
7. That
the developer extend water mains as required by the Water Services Department.
8. That
the developer construct sidewalks on the west side of N. Ambassador Drive and
the east side of N.W. Plaza Circle as required by the Department of Public Works
prior to the issuance of a building permit.
9. That
the developer grant an Aviation and Noise Easement to the City as required by
the Aviation Department prior ot the issuance of a building permit.
10. That
the developer comply with the KCI Airport Height zoning restrictions.
11. That
the developer eliminate the northbound left-turn lane on N. Ambassador Drive
and restore the width of the existing median to the south as required by the
Department of Public Works prior to the issuance of a building permit.
12. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for landscaping, grading, signage and building elevations.
A
copy of said development plan is on file in the office of the City Clerk under
Document No. 010229, which is attached hereto and made a part hereof.
Section
C. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
