Approving an amendment to a previously approved
development plan in District URD (Urban Redevelopment District) on
approximately a 5.42 acre tract of land generally bounded by 46th Street on the
north, 47th Street on the south, Summit Street on the west and Jefferson Street
on the east. (9497-URD-5)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved development plan in District URD (Urban Redevelopment
District) on approximately a 5.42 acre tract of land generally bounded by 46th
Street on the north, 47th Street on the south, Summit Street on the west and
Jefferson Street on the east, and more specifically described as follows:
Phase Two-A: Part of
Lots 15, 26 and 27, Home Place, and Lots 8 and 9, Huttig Subdivision, a
subdivision of land in Kansas City, Jackson County, Missouri, described as
beginning at the point of intersection of the north line of 47th Street as
established by Ordinance No. 47946 approved August 8, 1924, with the west line
of Jefferson Street as established by Ordinance No. 33076 approved July 9,
1906, run north along said west line of Jefferson Street, 203 feet; thence west
at right angles to said west line of Jefferson Street (along the centerline of
46th Street Terrace now vacated) to a point on the east line of said Lot 15,
thence north, along the east line of said Lot 15, to its intersection with the
north line of 46th Street Terrace now vacated; thence west, along the north
line of 46th Street Terrace now vacated, to a point 147 feet west of said west
line of Jefferson Street; thence north along a line parallel with said west
line of Jefferson Street, 13 feet, more or less, to the easterly prolongation
of the northerly line of Lot 1, Plaza Steppes, a subdivision of land in Kansas
City, Jackson County, Missouri; thence west 87 feet, more or less, on said
easterly prolongation to the northeast corner of said Lot 1; thence south on
the east line of said Lot 1, 250 feet to a point of intersection with the north
line of 47th Street as relocated by Vacation Ordinance No. 51267 approved
October 20, 1925; and thence easterly along the north line of 47th Street as
defined by said Ordinance No. 51267 and 47976, 235 feet, more or less to the
point of beginning.
Phase Two-B: Lot 14,
Home Place, except the north 60 feet of the east 100 feet thereof, together
with that part of Lot 15, of said Home Place, a subdivision of land in Kansas
City, Jackson County, Missouri, described as follows: Beginning at the
northwest corner of said Lot 15; thence south on the east line of said Lot 15,
59 feet, more or less, to the northwest corner of Lot 1, Plaza Steppes, a
subdivision of land in Kansas City, Jackson County, Missouri; thence east on
the north line of said Lot 1 and its easterly prolongation, 242 feet, more or
less, to a point 147 feet west of the west line of Jefferson Street as
established by Ordinance No. 33076, approved July 9, 1906; thence south on a
line 147 feet west of and parallel with, the west line of Jefferson Street, 12
feet, more or less, to a point on the north line of vacated 46th Street
Terrace; thence east on the north line of vacated 46th Street Terrace, 38 feet,
more or less, to the east line of said Lot 15; thence north on the east line of
said Lot
15, 72 feet, more or
less, to the northeast corner of said Lot 15; thence west on the north line of
said Lot 15, 280 feet, more or less, to the northwest corner of said Lot 15 and
the point of beginning.
Phase Three: All of Lots
12, 13 and the north 60 feet of the east 100 feet of Lot 14, Home Place, a
subdivision of land in Kansas City, Jackson County, Missouri, and together with
all of Lots 1 thru 8, Huttig Subdivision, a subdivision of land in Kansas City,
Jackson County, Missouri, except that part of said Lot 8, lying south of the
centerline of vacated 46th Street Terrace.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be replatted and reprocessed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for approval
and that the developer make any improvements as required by the City Engineers
Office.
3. That
the developer relocate or retire the existing water main on 46th Street Terrace
according to the specifications of the Water Services Department and relocate
or adjust fire hydrants accordingly.
4. That
the developer construct separate eastbound left turn lanes on 47th Street at
Summit Street and at Jefferson Street as required by the Department of Public
Works.
5. That
the developer dedicate additional right of way for Summit Street as required by
the Department of Public Works so as to provide 30 feet of right of way as
measured from the centerline of Summit Street.
6. That
the developer dedicate additional right of way for 46th Street as required by
the Department of Public Works so as to provide 30 feet of right of way as
measured from the centerline of 46th Street.
7. That
the developer dedicate additional right of way for Jefferson Street as required
by the Department of Public Works so as to provide 30 feet of right of way as
measured from the centerline of Jefferson Street.
8. That
the developer widen Summit Street between 46th Street and 47th Street from its
present pavement width of 25 feet to a pavement width of 37 feet to provide two
through lanes and one turn lane as required by the Department of Public Works.
9. That
the developer widen 46th Street between Summit Street and Jefferson Street from
its present pavement width of 25 feet to a pavement width of 33 feet to provide
two through lanes and one turn lane as required by the Department of Public
Works.
10. That
the developer construct a westbound right turn lane on 47th Street at its
intersection with Summit Street as required by the Department of Public Works.
11. That
the developer contribute to the Plaza Environs Study Area Improvement Fund at
the rate of $1.00 per gross square foot of office space, $350.00 per hotel
room, $1.80 per gross square foot of retail space over 25,000 square feet,
$2.70 per gross square foot of theater space, $2.50 per gross square foot of
restaurant space and $200.00 per apartment unit for every unit in excess of the
existing 226 apartment units.
12. That
the developer contribute $14,420.78 in lieu of parkland dedication for 112
multi-family units (112 x 2 x 0.006 x $10,729.75) in satisfaction of Section
66-128 of the Subdivision Regulations.
13. That
the developer submit a site plan to the Director of the Department of City
Development for approval prior to the issuance of a building permit. The site
plan shall include: development plan information, property uses, setback
distances, lighting, landscaping, signage and architectural characteristics and
further shall include:
a. Pedestrian
connection between Phase 2b office building and the Phase 2a office/retail
complex.
b. Interior
space connections, both for vehicular and pedestrian movements, between the
hotel development and the Phase 2a office/retail complex.
c. Re-examination
of Phase 2b and Phase 3 sites as to location and relationship with the entire
development prior to the issuance of a permit for Phase 2b.
d. Architectural,
streetscape and pedestrian relationship between Phase 2b office building and
the hotel development in Phase 1.
A copy of said amendment is on file in the
office of the City Clerk under Document No. 981073, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
