ORDINANCE NO. 040151

 

Approving the preliminary plat of Browns Replat of a portion of Lot 6, Maborn on approximately a 1 acre tract of land generally located at 104 E. 109th Street. (SD 1076)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Browns Replat of a portion of Lot 6, Maborn on approximately a 1 acre tract of land generally located at 104 E. 109th Street, and more specifically described as follows:

 

This is a survey and subdivision of Lot 6, except the east 255 feet and except the west 100 feet, Maborn, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, more particularly described as follows: Commencing at the southwest corner of said Lot 6, being also a point on the northerly right-of-way line of 109th Street, as now established; thence South 86 degrees 49 minutes 07 seconds East along the southerly line of said Lot 6 and along said northerly right-of-way line, a distance of 100 feet to the point of beginning of the tract of land to be herein described; thence North 03 degrees 20 minutes 49 seconds East along a line 100 feet east of and parallel with the westerly line of said Lot 6, a distance of 286 feet to a point on the northerly line of said Lot 6; thence South 86 degrees 49 minutes 07 seconds East along the northerly line of said Lot 6, a distance of 150 feet to a point 255 feet west of the easterly line of said Lot 6, as measured perpendicular to the easterly line thereof; thence South 03 degrees 20 minutes 49 seconds West along a line 255 feet west of and parallel with the easterly line of said Lot 6, a distance of 286 feet to a point on the southerly line of said Lot 6, being also a point on the northerly right-of-way line of said 109th Street; thence North 86 degrees 49 minutes 07 seconds West along the southerly line of said Lot 6 and along said northerly right-of-way line, a distance of 150 feet to the point of beginning. Containing 42,900 square feet or 0.985 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer receive the approval of the Board of Zoning Adjustment for variances to required rear yard setback for the northern residence, lot width (of Lot 6B) and any other necessary variances required to allow the existing single-family residence to remain prior to the final plat being reviewed by the City Plan Commission.

 

3. That the developer submit a detailed storm drainage study to the City Engineers Office prior to approval and issuance of any building permits, that consists at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site and that the developer construct any improvements as required by the City Engineer's Office.

 

4. That the developer extend sanitary sewer to serve Lot 6B as required by the Department of Public Works prior to recording of the final plat.

 

5. That the developer construct or repair curbs, gutters and sidewalks on the north side of E. 109th Street as required by the Department of Public Works prior to recording of the final plat.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 040151, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
