Approving the preliminary plat of
Broadway Summit Condominiums on a 2.28 acre tract of land generally located at
3101 Broadway (southeast corner of 31st Street and Broadway). (SD 1353)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat Broadway Summit Condominiums on a 2.28 acre tract of land
generally located at 3101 Broadway (southeast corner of 31st Street and
Broadway), and more specifically described as follows:
All
of Lots 1, 2, 3, 4 and 5, "Jackson and Miller's Subdivision", filed December
14, 1913 as Document No. 956394 in Plat Book B-18, page 33 and Lots 17, 18, 19,
20, 21, 22, 23 and 24, together with all vacated Plum Street north of and
adjoining said Lots 20 and 21, "Amended Plat of Greystone", filed June
24, 1902 as Document No. 416916 in Plat Book B-11, page 70, both subdivisions
in Kansas City, Jackson County, Missouri according to the recorded plats
thereof, except that part of the additional right of way taken for 31st Street
in Document No. 2005 k0034870 being more particularly described as follows: Beginning
at the southwest corner of Lot 17 of said "Amended Plat of Greystone",
said point being on the east line of Broadway, as now established; thence North
3-19'-13" East along the east line of said Broadway, a distance of 304.13
feet to a point on the southerly line of 31st Street as established by said Document
No. 2005 K0034870; thence the following courses along the southerly line of
said 31st Street; North 37-27'50" East, a distance of 45.20 feet; thence South
86-30'-06" East, a distance of 200.00 feet; thence South 3-28'-34" West,
a distance of 4.00 feet; thence South 86-57'-56" East, a distance of
86.32 feet to a point on the west line of Central Street, as now established;
thence the following courses along the west line of said Central Street; South
3-25'-45" West, a distance of 117.99 feet; thence southerly along a curve
to the right, tangent to the last described course, having a radius of 125.00
feet, a central angle of 30-30'-32", an arc distance of 66.56 feet;
thence southerly along a curve to the left, tangent to the last described
course, having a radius of 175.00 feet, a central angle of 30-45'46", an
arc distance of 93.96 feet; thence South 3-07'-33" West, a distance of
67.06 feet to the southeast corner of Lot 24 of said "Amended Plat of Greystone";
thence North 86-31'19" West departing the east line of said Central Street,
along the south line of Lots 17 and 24 of said "Amended Plat of Greystone",
a distance of 270.00 feet to the point of beginning. The above description
contains 99,501 square feet or 2.284 acres.
is hereby approved, subject to
the following conditions:
1. That the developer cause the area to be platted and processed
in accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That all wall dimensions and all floor and ceiling elevations for
each of the condominium units be shown on the final plat.
3. That the developer secure permits to repair existing or
reconstruct, sidewalks, curbs, gutters as necessary along all development
street frontages, or submit a letter from a Missouri licensed civil engineer
stating that the sidewalks, curbs, and gutters are in a good state of repair
and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances,
as required by Development Services, prior to recording the plat.
4. That
the developer submit covenants, conditions and restrictions to Development
Services for review by the Law Department for approval for the maintenance
of common elements.
5. That dedication of additional right of way for 31st Street and Broadway is hereby waived.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
