COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090947

 

Approving the Amended and Restated “353” Development Plan submitted by the Beacon Hill Redevelopment Corporation for the redevelopment of approximately a 94 acre tract of land generally bounded by 22nd Street on the north, Bruce R. Watkins Drive and The Paseo on the east, 27th Street and approximately 100 feet south of 27th Street at Troost Avenue on the south and Troost Avenue and approximately 150 feet west of Troost Avenue at 27th Street on the west; declaring the area included in such plan to be a blighted area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; authorizing the Director of Finance to enter into a contract with the Beacon Hill Redevelopment Corporation and an Assignment and Assumption Agreement of contract with Beacon Hill Redevelopment Corporation, the Housing Authority of Kansas City Missouri related to certain rights with respect to Phase 2A of the Beacon Hill Project; authorizing certain tax abatement within the plan area; and authorizing the Mayor to issue a Certificate of Public Convenience and Necessity. WHEREAS, the Beacon Hill Redevelopment Corporation, an urban redevelopment corporation organized under and pursuant to the Urban Redevelopment Corporations Law and amendments thereto, did file with the City Clerk an application for the approval of a 353" development plan which was approved by the City Council by Committee Substitute for Ordinance No. 020442, passed May 23, 2002, and said ordinance authorized a contract between the City and Beacon Hill Redevelopment Corporation governing the implementation of the development plan (hereinafter referred to as “Redevelopment Contract”); and

WHEREAS, the City of Kansas City, Missouri, and the Beacon Hill Redevelopment Corporation entered into the Redevelopment Contract dated July 23, 2002 and recorded in the office of the Recorder of Deeds for Jackson County, Missouri at Kansas City, on August 17, 2004 as Document No. 2004K0055517; and

 

WHEREAS, the Redevelopment Contract allows for the assignment of rights and obligations contained therein with the approval of the City; and

 

WHEREAS, Beacon Hill Redevelopment Corporation did file with the City Clerk an application for the Amended and Restated “353” Development Plan on September 4, 2009, and 

 

WHEREAS, the City Clerk did refer said application for the Amended and Restated “353” Development Plan to the City Plan Commission; and

 

WHEREAS, legal notice of a public hearing on the proposed Amended and Restated “353” Development Plan was published on a date being not less than fifteen days prior to the date set for the public hearing on said development plan; and

 

WHEREAS, the City Plan Commission did hold a public hearing on the Amended and Restated “353” Development plan on November 3, 2009; and

 

WHEREAS, at the public hearing conducted by the City Plan Commission, all interested parties were given an opportunity to be heard at said public hearing; and

 

WHEREAS, the City Plan Commission has made a study and investigation of the proposed Amended and Restated “353” Development Plan on November 3, 2009, recommended approval of said development plan, including a recommendation of approval concerning the finding of blight, and did submit a report of the same, a copy of which is attached hereto and incorporated herein by reference as Exhibit A;

 

WHEREAS, the Beacon Hill Redevelopment Corporation desires to assign and transfer its rights, obligations and interest in the development as to that portion of the Beacon Hill Project that is located within Phase 2A of the Amended and Restated “353” Development Plan and legally described on Exhibit B, to the Housing Authority of Kansas City, Missouri; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Amended and Restated “353” Development Plan submitted by the Beacon Hill Redevelopment Corporation for the redevelopment of an area of approximately 94 acres generally bounded by 22nd Street on the north, Bruce R. Watkins Drive and The Paseo on the east, 27th Street and approximately 100 feet south of 27th Street at Troost Avenue on the south and Troost Avenue and approximately 150 feet west of Troost Avenue at 27th Street on the west, a copy of which is on file in the office of the City Clerk, which is attached hereto and incorporated herein by reference, is hereby approved, as modified November 18, 2009. 

Section 2. That the Council finds and declares that the area being described in the aforesaid development plan submitted by the Beacon Hill Redevelopment Corporation is a socially and economically blighted area as defined by Section 353.020(2), Revised Statutes of Missouri, and Section 74-4, Code of Ordinances of the City of Kansas City, Missouri, and the redevelopment thereof is necessary for the public convenience and necessity; and that approval of the development plan and construction of the redevelopment project are necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare. 

Section 3. That the Amended and Restated “353” Development Plan be approved with respect to the findings as set forth in Exhibit A.

Section 4. That the financing for the project is adequate based upon the reasonable costs proposed in the development plan.

Section 5. That the Beacon Hill Redevelopment Corporation is hereby granted tax abatement on the land and improvements for the redevelopment of the area as described in Exhibit A. 

Section 6. That the Director of Finance be and is hereby, authorized and directed on behalf of the City to enter into an amended contract with the Beacon Hill Redevelopment Corporation for the redevelopment of approximately a 94 acre tract of land generally bounded by 22nd Street on the north, Bruce R. Watkins Drive and The Paseo on the east, 27th Street and approximately 100 feet south of 27th Street at Troost Avenue on the south and Troost Avenue and approximately 150 feet west of Troost Avenue at 27th Street on the west. 

Section 7. That the assignment of the development rights, obligations, and interest in and to Phase 2A of the Amended and Restated “353” Development Plan affecting all of the property legally described in Exhibit B, from the Beacon Hill Redevelopment Corporation to the Housing Authority of Kansas City, Missouri, is hereby approved and the Director of Finance is hereby Authorized to enter into an Assignment and Assumption Agreement with Beacon Hill Redevelopment Corporation and the Housing Authority of Kansas City, Missouri, the substantial form is attached hereto as Exhibit C.
