ORDINANCE NO. 940336
Amending Chapter 29 of the Code of General Ordinances of
Kansas City, entitled "Sewers and Sewage Disposal", by repealing
Sections 29.2, 29.2.1 and 29.48 and enacting in lieu thereof new sections of
like number and subject adjusting charges for sewer service.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 29 of the Code of General
Ordinances of Kansas City, Missouri, entitled "Sewers and Sewage
Disposal", is hereby amended by repealing Sections 29.2, 29.2.1 and 29.48
and enacting in lieu thereof new sections of like number and subject, said
sections to read as follows:
Section 29.2. Sewer charges-Levy, purposes, amount.
There is hereby levied a charge against every
person, firm, partnership, corporation and association occupying property
having a sewer connection with the sanitary sewer system of Kansas City,
Missouri or having sanitary sewers available for connection, or otherwise
discharging sewage, industrial waste, water or other liquid into the City's
sewer system, said charge to be used to pay the cost of operating, maintaining,
repairing or enlarging the existing or future sanitary sewer system and for
paying the principal of and the interest on the negotiable interest-bearing
sewer revenue bonds of the City, said charge to be the sum of a service charge
and volume charge to be computed and levied as follows:
(a) Domestic users. For residential water service
accounts (one and two-family residences), a service charge and
volume charge each as established in (b) of
this section,
except that for the billing periods most
closely
corresponding to the months of April through
November
both inclusive, the volume charge shall be
based upon
water used during the winter period, said
winter period
being the billing periods most closely
corresponding to
the months of December through March: said
charges shall
be payable with each bill rendered throughout
the year.
Where residential water service accounts do not
have an
acceptable history of winter water use, the
volume charge
for the period April through November shall be
the volume
charge established in (b) of this section, or
four
dollars and fifty cents ($4.50) per month,
whichever is
the lesser.
(b) Commercial and industrial users. For
commercial and industrial users (defined as all persons and
corporations
other than the occupants of one and two-family
dwellings):
(1) A service charge of three dollars and
thirty cents
($3.30) where bills are rendered monthly
or four
dollars and fifty cents($4.50) where bills
are
rendered bi-monthly to defray in part the
cost of
making available facilities and works now
or in
the future necessary for sewage treatment,
and
rendering bills for service, such charges
to be
made each and every month where a monthly
billing
is involved or each and every bi-monthly
period
where bi-monthly billings are involved,
regardless
of whether or not any sewage or wastes are
actually
discharged to the sewer during the billing
period;
and
(2) A volume charge per month based on the
total volume
of water purchased by the customer during
the month
as follows:
All Volume: Sixty-four cents ($0.64) per
one
hundred (100) cubic feet
(3) Where water is supplied by a separate and
independent source, the sewage volume
charge shall
be based upon the volume of water used,
computed as
rates established by (b) (2) of this
section. The
minimum volume charges for such users
shall be four
dollars and fifty cents ($4.50) per month.
Section 29.2.1 Same--Nonresident users.
A sewer service charge for all persons, firms,
partnerships, corporations and associations occupying property having a sewer
connection with the sewer system of the city, or otherwise discharging sewage,
industrial wastes, water or other liquids into the city sewer system, but who
reside or are situated outside the city limits, will be determined by applying
the applicable provision of subsection (a) or (b) of Section 29.2, except that
for these customers, the service charge shall be three dollars and sixty cents
($3.60) where bills are rendered monthly or six dollars ($6.00) where bills are
rendered bi-monthly, plus a volume charge of $0.71 per hundred cubic feet.
This section shall not be applicable where arrangements for sewer service and
sewer service charges are established by existing or future intergovernmental
contracts approved by the City Council.
Section 29.48 Surcharge when permissible
concentration of suspended solids or BOD is exceeded.
(a) Imposition. When the suspended solids content
or the BOD of a waste exceeds the maximum concentration of these components in
normal sewage, a surcharge, in addition to the normal sewer service charge,
shall be levied and established by the formula hereinafter set forth, but in no
event shall said surcharge be less than five dollars ($5.00) per month.
(b) Computation of Amount. The surcharge shall be
computed by using the formula:
S=Vs x 0.00624 x [$0.086 (BOD-300) + $0.054 (SS-360)] +
ESC which shall signify the amount of surcharge based on a combination of the
strengths of BOD (biochemical oxygen demand) and SS (suspended solids) above
those of normal sewage as defined herein, plus an ESC (extra strength control)
charge.
The BOD component of the formula shall equal the factor
of 0.00624 for converting milligrams per liter to pounds per hundred cubic
feet, multiplied by the volume of sewage in hundred cubic feet, multiplied by
$0.086, the estimated cost for treatment of one (1) pound of BOD in the raw
sewage, multiplied by the concentration of BOD in milligrams per liter minus
300, the strength for normal sewage.
The suspended solids component of the formula shall equal
the factor of 0.00624 as defined in the BOD component, multiplied by the volume
of sewage in hundred cubic feet, multiplied by $0.054, the estimated cost of
treatment of one (1) pound of suspended solids in the raw sewage, multiplied by
the concentration of suspended solids in milligrams per liter minus 360, the
strength for normal sewage.
The extra strength control charge shall be the actual
departmental cost for each individual user, including, overhead related to
obtaining, measuring and analyzing sewage samples to determine sewage strengths
for billing purposes. The Director shall determine the method and frequency of
said testing as may be reasonable for each customer in accordance with
recognized engineering practices; provided, however, that a user shall be
entitled to additional sampling at its request upon payment of additional costs
therefor. In lieu of sampling and analysis by the City, the Director, at his
discretion, may permit a user to collect and analyze samples of its own sewage
at its own expense, providing samples are taken at least annually, collected
and analyzed in accordance with provisions of the latest editions of
"Standard Methods for the Examination of Water and Wastewater", and
the results are certified by a Professional Engineer registered in the State of
Missouri. The City reserves the right to verify submitted data.
The symbols, letters or figures employed in the formula
signify the following:
S = Extra strength surcharge in dollars
Vs = Sewage volume in hundred cubic feet
0.00624 = Conversion factor for milligrams per liter to
pounds per hundred cubic feet
$0.086 = Unit O&M charge for BOD in dollars per
pound
BOD = BOD strength in milligrams per liter
$0.054 = Unit O&M charge for suspended solids in
dollars per pound
SS = Suspended solids strength in milligrams per
liter
ESC = Extra strength control charge
(c) Treatment to Reduce Concentrations. The owner
of any commercial or industrial establishment may, if so desired, treat the
wastes from such establishment so as to reduce either the excess suspended
solids or BOD, or both, to normal levels before discharging such wastes into
the public sewers. In cases where it is believed such wastes may be
deleterious to the sewerage works or have an adverse effect upon the sewage
treatment process or the receiving stream, the Director may require treatment
to reduce either or both the suspended solids and BOD to levels more closely
approaching those of normal sewage before discharging said wastes into the City
sewers.
Section B. This ordinance and the revised sewer
service charge specified herein shall become effective and shall apply to all
sewer service accounts for which billings are issued on or after May 1, 1994.
