ORDINANCE NO. 000029

 

Authorizing an Amended and Restated Memorandum of Agreement with the FAA to add terms and conditions for construction of a new general aviation airport at Richards-Gebaur Memorial Airport.

 

WHEREAS, the City of Kansas City and the United States of America through the Federal Aviation Administration ("FAA") have entered into a Memorandum of Agreement dated July 14, 1998 ("1998 MOA"), which permits the City to close the runway at Richards_Gebaur Memorial Airport and to develop an intermodal freight facility; and

 

WHEREAS, thereafter, the City Council by Resolution No. 990749, dated May 20, 1999, expressed its intent to construct a new general aviation runway at Richards_Gebaur Airport; and

 

WHEREAS, in order to provide for the construction of a replacement airport at Richards_Gebaur Airport it is necessary to restate the 1998 MOA and to amend it to add the terms and conditions that would apply during the planning for and construction of a replacement airport; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Aviation is hereby authorized to execute an Amended and Restated Memorandum of Agreement with the FAA, which restates the 1998 MOA and adds the terms and conditions which would apply during the planning and construction of a relocated general aviation airport on Richards_Gebaur property, in substantial compliance with Exhibit "A", attached hereto and incorporated herein.
