RESOLUTION NO. 130708

 

Endorsing the use of labor agreements in the construction of the starter line of the Kansas City Downtown Streetcar project.

 

WHEREAS, Committee Substitute for Ordinance No. 130606 authorizes the Director of Public Works to execute a construction manager at risk (CM@Risk) contract with KC Streetcar Constructors for the starter line of the Kansas City Downtown Streetcar project (Project); and

 

WHEREAS, Phase II of the Project covers procurement of all necessary contractors and subcontractors to complete the Project in full satisfaction and compliance with the contract and all applicable federal, state and City requirements including all Federal Transit Administration (FTA) rules and regulations; and

 

WHEREAS, according to the CM@Risk contract, KC Streetcar Constructors shall solicit and competitively bid all packages through the City’s website and the Kansas City Plan Room for 5 out of 20 days prior to bid opening; and

 

WHEREAS, KC Streetcar Constructors will be allowed to self-perform up to 25% of the work and may not self-perform additional work without prior written consent of the City; and

 

WHEREAS, all bids shall be publicly opened and shall be reviewed with the City and the Project’s Design Professional to identify the lowest and best responsive bidder for each bid; and

 

WHEREAS, the City Council believes that this Project must provide opportunities for local contractors and workers to be a part of the bid packages for Phase II; and

 

WHEREAS, it is the City Council’s desire that the use of labor agreements will be considered by KC Streetcar Constructors for this Project in compliance with all federal, state, and local regulations; and

 

WHEREAS, the use of labor agreements will provide a sound pool of skilled labor needed for a successful completion of the Project; and

 

WHEREAS, KC Streetcar Constructors has publicly expressed a commitment to engage in collective bargaining agreements with local unions to provide the workers needed to complete the Project; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Council fully endorses the use of labor agreements for the completion of the Project.

 

Section 2. That the Director of Public Works is directed to report on the specific project labor agreements entered into for the Project between KC Streetcar Constructors and unions.

 

Section 3. That the CM@Risk contract between KC Streetcar Constructors and the City authorized by Committee Substitute for Ordinance No. 130606 deals exclusively with the starter line of the Project and that any future potential lines or extensions will be subject to independent and separate procurement processes in compliance with all applicable rules and regulations.

 

Section 4. That the recommendations and endorsements expressed in this Resolution reflect the sense of the City Council and will be implemented in compliance with all applicable federal, state and local laws.
