ORDINANCE NO. 160853

 

Amending a previously approved development plan in District R-2.5 to permit changes to building design and materials, landscaping and recreational amenities for Phase I of Country Creek Townhomes, a 110-unit townhome development, generally located on the west side of Pryor Road, north of Bannister Road. (9619-P-10)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District R-2.5 to permit changes to building design and materials, landscaping and recreational amenities for Phase I of Country Creek Townhomes, a 110-unit townhome development, generally located on the west side of Pryor Road, north of Bannister Road, and more specifically described as follows:

 

TRACT 1: Country Creek Townhomes First Plat, Lot 1.

 

TRACT 2: Country Creek Townhomes First Plat, Lot 2.

 

TRACT 3: Country Creek Townhomes First Plat, Lot 3.

 

TRACT 4: Country Creek Townhomes First Plat, TR H.

 

TRACT 5: Country Creek Townhomes First Plat, Lot 4.

 

TRACT 6: Country Creek Townhomes First Plat, TR-P.

 

TRACT 7: Country Creek Townhomes First Plat, Lot 5.

 

TRACT 8: Country Creek Townhomes First Plat, Lot 6.

 

TRACT 9: Country Creek Townhomes First Plat, Tract T.

 

is hereby approved, subject to the following conditions:

 

1.                  That the plans shall be revised prior to building permit to show:

 

a.                   A landscape plan of the entire area of Phase I, depicting compliance with Condition 19 of Ordinance No. 050779 showing one canopy shade tree a maximum of 50 feet on center along Pryor Road frontages, one canopy shade tree between every other driveway along interior streets (and an average of 30 feet on center along portions of street frontages without driveways), ornamental trees between alternating driveways, a minimum of 34 canopy shade trees within the 150 foot buffer, and at least one tree per unit in the rear or side yards alternating between evergreen and canopy shade trees.

 

b.                  A note be placed on the plan stating “Subsequent construction drawings submitted for building permits on future buildings within Phase I shall match, precisely, the details of the approved development plan as it relates to landscaping, splash pool and related recreational amenities, and building exteriors including design, material and color. Additionally, no changes from the approved construction drawings shall be made in the field without prior approval of the Development Management Division Manager.”

 

c.                   The fish scale shingles shall be replaced with shake shingles.

 

d.                  Show new wood fence extending from the south end of the existing vinyl fence to the south end of Lot 96, Wedgewood Pointe to fill gaps in places where existing fences on properties in Wedgewood Pointe do not exist.

 

2.                  The developer shall cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of Kansas City, Missouri.

 

3.                  A left turn lane with taper shall be constructed on southbound Pryor Road at Bannister Road per the traffic study, left turn lanes with tapers shall be constructed on Pryor Road at each driveway entrance per the traffic study, and Pryor Road between those improvements shall be widened to a minimum of 32 feet in paved width including sidewalks on the west side prior to the issuance of any certificates of occupancy for any buildings within the development plan.

 

4.                  Prior to the issuance of any certificates of occupancy for any building within the development plan, the developer shall construct and maintain an emergency access to Bannister Road via the emergency ingress/egress easement in this plan and Wedgewood Pointe 3rd Plat which:

 

a.                   meets the requirements of the Fire Department and Public Works Department,

 

b.                  is constructed of a chip and seal material capable of supporting emergency equipment,

 

c.                   is not open for general public use, and

 

d.                  will be gated with a “breakaway” design approved by the Fire Department upon a determination by the Director of Public Works that gating is required in the interest of public safety.

 

5.                  The developer shall submit a macro/micro storm drainage study to Development Services for approval for the entire development when the first plat is submitted, and the developer shall construct any improvements as required by Development Services.

 

6.                  The developer shall submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

7.                  The developer shall obtain a land disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

8.                  The developer shall extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed buildings and determine adequacy as required by Development Services.

 

9.                  The developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and the developer shall be responsible for all costs associated with subordination activities.

 

10.              The developer shall secure the approval of the Missouri Highway and Transportation Department for any work within State right of way.

 

11.              Adequate sight distance shall be provided for each street connection to Pryor Road as required by Development Services.

 

12.              The developer shall design and construct all interior streets to City standards as required by Development Services, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

13.              The developer shall obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

14.              Any relocated streetlights shall be integrated into the existing streetlight system as required by Development Services and the Missouri and Highway Transportation Department along State frontages.

 

15.              The developer shall install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

16.              The developer shall extend water mains and grant easements as required by the Water Services Department.

 

17.              The developer shall contribute $3,426.79 in lieu of parkland dedication for 192 units (192 units X 2.0 X .006 (less credit for 1.96 acres of private open space) X $9,961.61 = $3,426.79) in satisfaction of the Subdivision Regulations, with credit for any approved private open space.

 

18.              The developer shall receive approval of a Certificate of Survey or a lot split prior to the sale of individual units.

 

19.              The splash pool and related recreational features (playground) depicted on the approved plan shall be constructed, installed and ready for use prior to issuance of a final certificate of occupancy for the last residential structure in Phase I.

 

20.              Subsequent construction drawings submitted for building permits on future buildings within Phase I shall match, precisely, the details of the approved development plan as it relates to landscaping, splash pool and related recreational amenities, and building exteriors including design, material and color. Additionally, no changes for the approved construction drawings shall be made in the field without prior approval of the Development Management Division Manager.

 

21.              The applicant shall also complete the following prior to issuance of a final certificate of occupancy for the last residential structure in Phase I:

 

a.                   Replace three already planted maple trees with evergreens behind one building.

 

b.                  Repair the white vinyl existing fence.

 

c.                   Repair the existing wood fence along the access road.

 

d.                  Leave all trees along that fence in excess of 3" caliper.

 

e.                   Bury two downspouts to daylight in the existing swale developer put in to divert run off that was not on the plans.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
