COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 051550
Approving the First Amendment to
the General Development Plan for the Downtown Loop Area by expanding the area
to include an approximately .30 acres tract of land generally located at the
northeast corner of 12th Street and McGee Street; finding the plan to
be in compliance with Sections 100.300-100.620, RSMo; and approving ad valorem
tax benefits therefore.
WHEREAS, the
Planned Industrial Expansion Authority of Kansas City, Missouri, (the
Authority) adopted Resolution No. 790 on August 15, 2003, finding that the
area described in the Resolution to be blighted pursuant to the PIEA Law and
recommending to the City Council that said area be designated as a blighted,
insanitary or underdeveloped industrial area defined by Section 100.310
(2, 11 and 18), RSMo; and
WHEREAS, said
area was declared to be blighted by the City Council through passage of
Committee Substitute for Ordinance No. 040146 on March 4, 2004, and a General
Development Plan was approved for the area known as the Downtown Loop General
Development Plan; and
WHEREAS, on
October 26, 2005, the Authority adopted Resolution No. 1050 accepting the
Amended Blight Study for the Downtown Loop PIEA Area and finding the additional
area of approximately .30 acres located at the northeast corner of 12th
Street and McGee Street to be a blighted, insanitary or underdeveloped
industrial area defined by Section 100.310 (2, 11 and 18), RSMo, and approving
the First Amendment to General Development Plan for the Downtown Loop Plan
Area;
WHEREAS, said
additional area was declared to be a blighted and insanitary area by the City
Council through the adoption of Resolution No. 051356 on November 10, 2005; and
WHEREAS, the
City Plan Commission reviewed and recommended approval of the First Amendment
to the General Development Plan for the Downtown Loop Area on December 20,
2005, and has found said plan to be in conformance with the general plan for
development of the community as a whole; and
WHEREAS, Section
100.400, RSMo, authorizes the Council to approve a general development plan
after a designation of blight if the Council finds the plan is feasible and in
conformity with the general plan for the redevelopment of the community as a
whole; and
WHEREAS, the
Council has determined that ad valorem tax exemption benefits as authorized by
Section 100.570, RSMo, are necessary to attract developers to the additional
area of the Downtown Loop Plan Area; NOW, THEREFORE,
BE IT RESOLVED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the First Amendment to the General Development Plan for the Downtown Loop Plan
Area, as shown in the First Amendment to the General Development Plan dated
October 13, 2005, as revised December 20, 2005, by including the additional
area of approximately .30 acres generally located at the northeast corner of 12th
Street and McGee Street in the Downtown Loop Plan Area, and said additional
area is more specifically described as follows:

The East 40 feet of
Lots 135 and 136 except that part of the East 40 feet of Lot 135 in Twelfth
Street, SWOPES ADDITION TO THE CITY OF KANSAS, now Kansas City, Jackson
County, Missouri; and
Tax Parcel No.
29-220-51-05-00-0-00-000 (no address):
The South 10 feet of
Lot 137 and the West 92 feet of Lofts 135 and 136, in SWOPES ADDITION TO THE
CITY OF KANSAS, now Kansas City, Jackson County, Missouri, except that portion
taken for street purposes.
is hereby approved. A copy of
said First Amendment to the General Development Plan for the Downtown Loop Plan
Area is attached hereto and incorporated herein by reference in Document No.
051550.
Section 2. That
this Council has duly made the findings necessary for compliance with Sections
100.300 through 100.620, RSMo.
Section 3. That
said First Amendment to the General Development Plan for the Downtown Loop Plan
Area is hereby found to be feasible and in conformance with the general
development plan for the development of the community as a whole.
Section 4. That the ad valorem tax exemption benefits as
authorized in Section 100.570, RSMo, are hereby extended to the plan area, as
amended by the First Amendment, to the extent and in the manner provided for in
said First Amendment to the General Development Plan for the Downtown Loop Plan
Area, subject to the execution of a development agreement with the Authority.

given and public hearings held, as required by law.
