COMMITTEE
SUBSTITUTE FOR ORDINANCE NO. 130173, AS AMENDED
Repealing Section 2 of Second
Committee Substitute for Ordinance No. 100951; and establishing a committee to
review future uses of the transportation sales tax.
WHEREAS, state
law limits the use of the transportation sales tax revenue to meeting the
City’s contractual obligations to KCATA, and for constructing, reconstructing,
maintaining, repairing, policing, signing, lighting and cleaning roads and
streets; and
WHEREAS, the
demands on this revenue increase as new modes of transportation are explored
and developed; and
WHEREAS, the
Citizens’ Commission on Municipal Revenue recommended that the City Council
approve a revenue policy applicable to all taxes and fees of the City; and
WHEREAS,
pursuant to Ordinance No. 121017, approved on December 20, 2012, the City
Council adopted a revenue policy which states that, whenever possible, the City
shall strive to not dedicate a revenue stream to a specific use or program as
dedication or earmarking of revenue streams does not allow the City to respond
to changing economic conditions or service expectations and may undermine the
City’s general credit; and
WHEREAS, a
council committee, balanced with its representation of standing committees,
should make recommendations to the full Council on expenditure of these funds
for future budgets; NOW, THEREFORE,
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That
Section 2 of Second Committee Substitute for Ordinance No. 100951 is hereby
repealed.
Section 2. That a
committee consisting of five councilmembers, with one councilmember from each
of the following committees: Finance Governance & Ethics Committee,
Planning Zoning & Economic Development Committee, Neighborhoods &
Healthy Communities Committee, Public Safety & Emergency Services
Committee, and Transportation & Infrastructure Committee, is established to
review Section 68-472.1, Code of Ordinances, and recommend a multi-year
financial plan for distribution of the transportation sales tax after reviewing
the needs of the bus service and establishing a maximum allocation for
development and expansion of a streetcar system. The
committee, appointed by the
Mayor, shall finalize its recommendations to the Council by August 1, 2013.
The City Manager will provide the appropriate staff to assist the committee.
