COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 061265
Approving
the plat of Executive Park Sixtieth Plat, an addition in Kansas City, Jackson
County, Missouri; accepting and releasing various easements; authorizing the
Director of City Development to execute and/or accept certain agreements; and
authorizing the City Clerk to file this ordinance and attached documents.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the plat of Executive Park Sixtieth Plat,
a subdivision in Kansas City, Jackson County, Missouri, a true and correct copy
of which is attached hereto and incorporated herein by reference, is hereby
approved.
Section 2. That the plat granting and reserving unto
Kansas City an easement and license or right to locate, construct, operate and
maintain facilities including, but not limited to, water, gas, sewerage,
telephone, cable TV, surface drainage, underground conduits, pad mounted
transformers, service pedestals, any and all of them upon, over, under and
along the strips of land outlined and designated on the plat by the words
utility easement or U/E be and the same are hereby accepted and where other
easements are outlined and designated on the plat for a particular purpose, be
and the same are hereby accepted for the purpose as therein set out.
Section 3. That all right,
title and interest in the following recorded easements be and the same are
hereby released to the respective owners, their successors or assigns, over
that part of aforesaid easement under the following:

Commencing at the
Northwest corner of Tract a, Executive Park Thirty-Fourth Plat, a subdivision
in the City of Kansas City, Jackson County, Missouri; thence South 874253
East, along the North line of said Executive park Thirty-Fourth Plat, a
distance of 2.00 feet, to a point on the centerline of said 20-foot wide storm
drainage easement; thence North 021557 East, along said centerline, a
distance of 30.00 feet, to a point on the North line of Tract A, Executive Park
Forty-Seventh Plat, a subdivision in said city, county and state, said point
also being the Point of Beginning; thence North 874253 West, along said
North line, a distance of 10.00 feet, to a point on the West line of said
20-foot wide storm drainage easement; thence North 021557 East, along said
West line, a distance of 170.00 feet; thence South 874403 East, along the
North end of said 20-foot wide storm drainage easement, a distance of 20.00
feet; thence South 021557 West, along the East line of said 20-foot wide
storm drainage easement, a distance of 170.00 feet, to a point on the North
line of Tract A of said Executive Park Forty-Seventh Plat; thence North
874253 West, along said North line, a distance of 10.00 feet, to the Point
of Beginning.

existing 10-foot wide sanitary sewer easement filed for record as Document No.
K-1108550 in Book K-2471 at Page 1630, described as follows:
Commencing at the
Northeast corner of Tract A, Executive Park Thirty-Fourth Plat, a subdivision
in the City of Kansas City, Jackson County, Missouri; thence South 874253
East, along the North line of said Executive Park Thirty-Fourth Plat, a
distance of 50.00 feet, to a point on the West line of said 10-foot wide
sanitary sewer easement; thence North 021557 East, along said West line, a
distance of 44.82 feet, to the Point of Beginning; thence continuing North
021557 East, along said West line, a distance of 963.35 feet; thence South
874403 East, departing said West line, a distance of 10.00 feet, to a point
on the East line of said 10-foot wide sanitary sewer easement; thence South
021557 West, along said East line, a distance of 963.35 feet; thence North
874403 West, departing said East line, a distance of 10.00 feet, to the
Point of Beginning.
Section 4. That the Director of City Development is hereby
authorized to execute a Covenant to Maintain Storm Water Detention Agreement,
to be in a form substantially as that attached hereto as Exhibit A and
incorporated herein by reference.
Section 5. That the Director of City Development is
hereby authorized to execute and/or accept any and all agreements necessary to
clear the title of any right of way, utility easements or other public property
dedicated on the plat.
Section 6. That the City Clerk is hereby directed to
file copies of this ordinance, together with the documents described herein and
all other relevant documents, when the plat has been released for recording,
together with the Covenant to Maintain Storm Water Detention Agreement, in the
Office of the Recorder of Deeds of Jackson County, Missouri.
Section 7. That the Council finds that the City Plan
Commission has duly endorsed its approval of this Ordinance hereon.
