ORDINANCE NO. 090659
Partially releasing various
easements in Clay and Platte Counties, Missouri, and directing the City Clerk
to record the documents.
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That all right,
title and interest in the following recorded easements be and the same is
hereby released to the respective owners, their successors or assigns, over
that part of aforesaid easement under the following:
1. A
partial release of an existing 15 foot wide Storm Drainage Easement as shown on
the Certificate of Survey as filed as Instrument No. 2008020787 in Book G at page
159, being all that part of Lot 4, North Oak Village as filed in Book G at page
126 as Instrument No. 2007032713, a subdivision in Kansas City, Clay County,
Missouri, described as follows:
Commencing
at the Southeast corner of Lot 4, North Oak Village; thence North 0 degrees 33
minutes 13 seconds East along the East line of said Lot 4 a distance of 25.96
feet to the point of beginning; thence South 39 degrees 45 minutes 00 seconds
West a distance of 10.66 feet to a point; thence North 50 degrees 15 minutes 00
seconds West a distance of 15.00 feet to a point; thence North 50 degrees 15
minutes 00 seconds East a distance of 29.05 feet to a point on the East line of
said Lot 4; thence South 0 degrees 33 minutes 13 seconds West along the East
line of said Lot 4 a distance of 23.73 feet to the point of beginning and containing
298 square feet or 0.007 acres, more or less.
2. A partial release of a
Standard Sewer Easement recorded in Document No. 31812, in Book 282 at page 147
in the Office of the Recorder of Deeds of Platte County, Missouri, and located
over part of Lot 3, Lot 5, Tract D and Tract E of Zona Rosa 2nd Plat", a
subdivision of land recorded in Document No. 34553, in Book 20 at page 6 in
said Office of the Recorder of Deeds, and also located over part of N. Congress
Avenue, N. Serene Avenue and N.W. 86th Street as all are now established, all
in the Northeast Quarter of Section 12, Township 51 North, Range 34 West of the
5th Principal Meridian in Kansas City, Platte County, Missouri and described
as follows:
A 10 foot wide permanent
easement lying 5 feet on either side of the following described centerline:
Beginning at a point on the West line of the Northeast Quarter of Section 12,
Township 51, Range 34, that is 490.00 feet South of the Northwest corner of the
Northeast Quarter of Section 12, Township 51, Range 34; thence 90 degrees East,
155.00 feet on a bearing of South 89 degrees 59 minutes East; thence South 0
degrees 01 minutes West, 247.00 feet; thence South 89 degrees 59 minutes East,
320.00 feet; thence South 0 degrees 01 minutes West, 170.00 feet; thence South
4 degrees 16 minutes West, 277.00 feet; thence South 21 degrees 44 minutes East,
150.00 feet; thence South 46 degrees 44 minutes East, 52.79 feet to a point on
the Southerly right of way line of N.W. 86th Street as established by the plat
of Zona Rosa 2nd Plat, a subdivision of land in said Kansas City, Platte
County Missouri, said point being the point of termination of said partial release.
The outer limits of said partial release shall be lengthened or shortened as
necessary to terminate on said Southerly right of way line at the point of
termination.
Section 2. That upon the effective date of this
Ordinance, the City Clerk is hereby directed to cause this Ordinance and
releases to be recorded in the office of the Recorder of Deeds for Clay and
Platte Counties, Missouri.
