COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 900147

Amending that part of the Line Creek Valley Area Plan by repealing those sections inconsistent with the Highway 45 Land Use and Transportation Study. (206-S-1)

WHEREAS, the Line Creek Valley Area Plan, approved by Resolution Number 47178, adopted December 22, 1976, was developed as a guide for the development and redevelopment of that area now described by the Highway 45 Land Use and Transportation Study; and

WHEREAS, the Highway 45 Land Use and Transportation Study has been completed and reflects changes to some areas previously covered by the Line Creek Valley Area Plan; and

WHEREAS, the City Development Department and Public Works Department through the Highway 45 Advisory and Technical Committees has initiated a study of the area known as the Highway 45 Land Use and Transportation Study for those portions in Kansas City generally bounded by N.W. 68th Street on the north, Interstate 29 on the east, and Missouri Route 9 on the south and west; and

WHEREAS, on June 19, 1990, the Kansas City, City Plan Commission recommended approval of the Highway 45 Lane Use and Transportation Study; and

WHEREAS, on July 17, 1990, the City Plan Commission, after public hearing and notice, recommended approval of the modifications to the Line Creek Valley Area Plan and recommended approval of such amendments to the City Council; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section A. That the Line Creek Valley Area Plan is hereby amended by repealing all portions inconsistent with the Highway 45 Land Use and Transportation Study. Such Plan shall be specifically amended as follows:

1. Elimination of the parkway status on N.W. 56th Street.

2. Elimination of commercial land use at N.W. 56th Street and Northwood Road.

3. Addition of commercial and office land use south of Highway 45 and west of I-29.

4. Addition of commercial land use south of Highway 45 and east of N.W. Klamm.

5. Modification of areas shown for low density residential to higher density residential.

All land use modifications are set forth on the Land Use Plan for Line Creek Study Area, as amended, a copy of which is attached hereto as Document 900147, which is incorporated herein and made a part hereof.

Section B. That in all other respects, the Line Creek Valley Area Plan remains in full force and effect.

Section C. That the Council finds and declares that before taking any action on the proposed Study, all public notices and hearings required by law have been given and had.
