COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 070934

 

Detaching approximately 18.97 acres generally located north of M-210 and the North Kansas City Hospital, east of Sunset Park, west of Rock Creek Park and south of The Hills of Rock Creek subdivision which is being concurrently annexed into the City of North Kansas City and directing the City Clerk to file certified copies of this ordinance with the required Clay County officials. (100-AN-5)

 

WHEREAS, the North Kansas City Hospital may develop property located adjacent to and north of existing North Kansas City Hospital property generally located east of Sunset Park, west of Rock Creek Park and south of The Hills of Rock Creek subdivision, now located within the city limits of Kansas City, Missouri; and

 

WHEREAS, this action will allow all of the North Kansas City Hospital ownership to develop within one municipality; and

 

WHEREAS, the City of Kansas City and the City of North Kansas City agree that services to the small portion of property not currently located within North Kansas City would be more efficiently provided by North Kansas City; and

 

WHEREAS, the property to be concurrently annexed by North Kansas City and detached by Kansas City abuts North Kansas City; and

 

WHEREAS, in exchange for the detachment of the 18.97 acres from Kansas City to North Kansas City, officials of North Kansas City Hospital agree to deed to the City of Kansas City Missouri, a 3.04 acre parcel located on the north side of the 18.97 acre parcel, which will serve to connect Sunset Park on the west and Rock Creek Park on the east both Kansas City parks; and

 

WHEREAS, all provisions of Section 71.011, Revised Statutes of Missouri, authorizing such concurrent detachment and annexation have been met; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Detachment of Property. That the following property, generally located north of M-210 and the North Kansas City Hospital, east of Sunset Park, west of Rock Creek Park and south of The Hills of Rock Creek subdivision, and more specifically described as:

 

A tract of land in the Southeast l/4 of Section 12, Township 50, Range 33, and the Southwest l/4 of Section 7, Township 50, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Southeast corner of Lot 24, Block 2, The Hills of Rock Creek - First Plat, a subdivision of land in Kansas City, Clay County, Missouri, according to the recorded plat thereof; thence South 08 33' 42" East, along the West line of a tract of land condemned by the City of Kansas City, Missouri for park and recreation purposes as described in City Ordinance No. 21676, 223.47 feet to the Point of Beginning; thence continuing South 08 33' 42" East, along said West line, 181.04 feet; thence South 04 22' 46" West, along said West line 593.17 feet; thence North 84 05' 37" East, 252.09 feet to a point on the East line of the Southeast l/4 of said Section 12; thence South 01 28' 49" West, along said East line, 59.04 feet; thence North 83 32' 43" East, 9.39 feet; thence South 27 52' 46" East, 360.03 feet to a point on the South line of the Southwest l/4 of said Section 7; thence North 89 04' 07" West, along said South line, 185.00 feet to the Southwest corner of said Southwest l/4; thence North 00 38' 10" East, along the West line of said Southwest l/4, 55.90 feet to the Southeast corner of the Southeast l/4 of said Section 12; thence North 89 38' 06" West, along the South line of said Southeast l/4, 1136.73 feet to a point on the Easterly line of a tract of land condemned by the City of Kansas City, Missouri, for park and recreation purposes as described in the aforesaid ordinance; thence North 00 50' 19" East, along said Easterly line, 27.99 feet; thence Northeasterly, along said Easterly line, on a curve to the Right, tangent to the last described course, having a radius of 269.59 feet, an arc distance of 227.30 feet; thence North 49 08' 49" East, along said Easterly line, tangent to the last described curve, 75.00 feet; thence Northeasterly, along said Easterly line, on a curve to the Left, tangent to the last described course, having a radius of 603.22 feet, an arc distance of 521.35 feet; thence Northerly, along said Easterly line, on a curve to the Left, having a common tangent with the last described curve, a radius of 1841.45 feet, an arc distance of 370.23 feet; thence South 85 10' 09" East 595.11 feet to the Point of Beginning, Containing 826,134 square feet or 18.97 acres more or less.

 

is hereby declared to be detached from the City of Kansas City effective upon the simultaneous and concurrent annexation of this property by the City of North Kansas City, and the transfer by deed of the 3.04 acre parcel located on the north side of the 18.97 acre parcel, from the North Kansas City Hospital to the City of Kansas City, Missouri; and

 

Section 2. Reason and Purpose for the Detachment and Annexation. That this concurrent detachment by the City of Kansas City and annexation by North Kansas City will allow North Kansas City to provide services to the property and eliminate the need for two municipalities to provide services to one area.

 

Section 3. That the City acknowledges that the Kansas City Board of Parks and Recreation Commissions intend to allow vehicular access through a corner of Rock Creek Park for the hospitals future development subject to construction and maintenance standards agreed upon by the Board of Parks and Recreation Commissioners and the Hospital.

 

Section 4. Filing. That the City Clerk will file a certified copy of this ordinance and a certified copy of the related annexation ordinance adopted by the City of North Kansas City in the office of the County Clerk of Clay County, the Recorder of Deeds of Clay County, and the Clerk of the Circuit Court of Clay County.
