ORDINANCE NO. 031069

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0514, rezoning an area of approximately 2.6 acres generally located 400 feet east of N.E. Searcy Creek Parkway on the north side of N.E. Russell Road from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0514, rezoning an area of approximately 2.6 acres generally located 400 feet east of N.E. Searcy Creek Parkway on the north side of N.E. Russell Road from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments), said section to read as follows:

 

Section 80-11A0514. That an area legally described as:

 

All that part of the Southeast Quarter of Section 5, Township 50, Range 32 in Kansas City, Clay County, Missouri, described as follows: Beginning at the southeast corner of said Section 5; thence South 89E24'48" West along the south line of said Southeast Quarter a distance of 400.00 feet; thence North 0E33'12" West parallel to the east line of said Southeast Quarter a distance of 110.00 feet; thence North 64E04'43" East , a distance of 198.08 feet measured, 196.26 feet deeded, to a point 194.76 feet north of the south line and 221.02 feet west of the east line of said Southeast Quarter; thence North 0E33'12" West parallel to and 221.02 feet west of the east line of said Southeast Quarter, a distance of 187.53 feet; thence North 89E24'48" East parallel to the south line of said Southeast Quarter, a distance of 221.02 feet to the east line of said Southeast Quarter; thence South 0E33'12" East along the east line of said Southeast Quarter, a distance 382.89 feet to the point of beginning. Said tract contains 2.566 acres more or less.

 

is hereby rezoned from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments), all as shown outlined on a map marked Section 80-11A0514, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.


2. That the developer submit an overall storm drainage study to the City Engineers Office for approval regarding both proposed developments at the time the first final plat is submitted, with detailed storm drainage studies to be submitted for each phase of development at the time of final platting, and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area of the entire development exceeds one acre.

 

6. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

7. That the developer secure a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

8. That the developer dedicate additional right of way for N.E. Russell Road as required by the Department of Public Works so as to provide a total of 30 feet of right of way as measured from the centerline of N.E. Russell Road.

 

9. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

10. That the developer extend sanitary and/or storm sewers and determine adequacy as required by the Department of Public Works and Water Services Department.

 

11. That the developer receive any necessary variances from the Board of Zoning Adjustment required to allow establishment of an eleemosynary use on the subject site.

 

12. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on grading, landscaping, signage (including elevations), and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 031069, which is attached hereto and made a part hereof.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
